An indictment was brought to the court in Olsztyn against a 74-year-old man who hit a 12-year-old boy at a pedestrian crossing in Kieźliny (Warmian-Masurian Voivodeship). After a few days, the boy died in the hospital. The man was charged with unintentionally causing a fatal road accident. He faces up to eight years in prison.
The indictment against the 74-year-old driver was brought to court by the Olsztyn-Północ District Prosecutor's Office. Roman J. was accused of unintentionally causing an accident in which a 12-year-old pedestrian died.
– According to the collected evidence, the injured party entered the crossing after the driver of another vehicle stopped in front of the crossing and let him pass – said Daniel Brodowski, spokesman for the District Prosecutor's Office in Olsztyn. The second car did not stop and hit the boy.
Roman J. pleaded not guilty to committing the act he was accused of. He explained that he did not see the boy crossing the lanes. He was sober at the time of the incident. The car he was driving was technically sound.
The accused was placed under police surveillance and banned from leaving the country. His driving license was also suspended.
My friend managed to jump away
The tragic event occurred on May 28 this year on the Wadąg-Słupy road. The driver of a Nissan passenger car at a pedestrian crossing hit 12-year-old Krzysztof B. The friend with whom the 12-year-old was crossing managed to jump away, and Krzysztof was hit by a speeding car.
The boy suffered extensive, multi-organ injuries and died on June 5 in the Provincial Children's Hospital in Olsztyn. After the boy's death, the authorities of the Dywity commune near Olsztyn decided to introduce mourning. The flags on the commune building and municipal institutions were girded with a black circle. Entertainment events organized by local government units have also been canceled.
For unintentional causing road accident with a fatal result is punishable by up to eight years' imprisonment.
