A 26-year-old man spent three months in a coma, who was doused with solvent and set on fire during a drinking party in Opole Lubelskie. Accused of attempted murder with particular cruelty, 49-year-old Jarosław O. was sentenced to 13 years in prison. Although he admitted to dousing his colleague with a flammable substance, he stated that he did not initiate the fire. The judgment is not final.

As determined by the District Prosecutor’s Office in Opole Lubelskie, on March 24 last year, an alcohol party was organized in the apartment of Jarosław O., attended by Marcin P. and three other people.

The next morning, Jarosław O. and Marcin P. had an argument, during which P. demanded the return of the money he had borrowed.

He suffered burns covering 28.5 percent of his body

The prosecutor’s office indicated that at some point P. fell asleep in the chair, while Jarosław O. brought a bottle of paint and varnish solvent from the bathroom, poured it on the victim and then set it on fire. Other people threw blankets on the burning man to put out the fire.

The injured man was taken to a hospital in Łęczna in a serious condition. He suffered burns covering 28.5 percent of his body. body – respiratory tract, head, forearms and thighs. He spent several months in a coma. Doctors diagnosed him with a serious detriment to his health in the form of a real life-threatening disease.

The victim wanted five million zlotys in damages

49-year-old Jarosław O. was detained and sent to prison. He claimed that the victim had doused himself with flammable liquid and set himself on fire. The prosecutor charged him with attempted murder with particular cruelty.

The trial of Jarosław O. started on February 2, 2023. During the first hearing, the victim did not accept the defendant’s apology, and then demanded five million zlotys in damages and a lifetime annuity from the 49-year-old.

Court: 13 years imprisonment

On Tuesday, the District Court in Lublin found Jarosław O. guilty of attempted murder with particular cruelty, sentenced him to 13 years in prison and ordered the payment of PLN 100,000 in damages to the victim.

Judge Andrzej Klimkowski, justifying the decision, stated that the defendant did not fully admit to the alleged act, while the evidence collected in the case confirmed the line presented by the prosecutor’s office in the indictment.

According to the judge, Jarosław O. “does not question the fact that as a result of the quarrel and conflict between him and the victim, he took out a container with a flammable liquid and poured it on the victim, but he completely denied that he initiated the fire that caused the injury “.

– In the court’s opinion, the explanation of the accused is not wholly credible – said the judge.

No criminal record as a mitigating circumstance

According to the court, the conduct of the accused “bears the characteristics of particular cruelty”, and “the scale of suffering and harm suffered by Marcin P. as a result of this crime” should be treated as an aggravating circumstance. Speaking about mitigating circumstances, the judge pointed to the previous clean criminal record of Jarosław O.

The court credited the accused with the period of detention and pre-trial detention as a penalty. After the verdict was announced, he extended his detention for another three months.

The judgment is invalid.
