Pardon of former CBA agents convicted in the so-called case land scandal. Władysław Kosiniak-Kamysz comments

President Andrzej Duda pardoned two former CBA agents, convicted in the case of the so-called land scandal. TVN24 was the first to learn about it. Earlier, Mariusz Kamiński and Maciej Wąsik were convicted and then pardoned by the president in the same case. Former CBA agents were sentenced to one year in prison.

Kosiniak-Kamysz: this case was very shocking

Deputy Prime Minister and head of the Ministry of National Defense, Władysław Kosiniak-Kamysz, commented on the president's decision in a conversation with journalists.

– It is clear that there is no will to, in my opinion, get to know this matter in depth. This case was very shocking, probably as a result of this, there was a tragedy, a whole series of events around Andrzej Lepper – he said.

– It was a provocation, it was falsification of documents, it was a terrible action against the then deputy prime minister, the minister of agriculture, with whom we were in a political dispute as PSL and we should probably be the last ones, as those who argued with him, competed in the countryside, to stand up for him – said Kosiniak-Kamysz.

He added that “this is not just a provocation, it is fabricating falsehoods and trying to write history without it happening.”

In response to the comment that the president is consistent and pardons everyone in this case, he said that “I don't really understand why there is such uniformity in the president's position.” He noted that Andrzej Duda “has the right to do so, the right of pardon is the president's prerogative, but he assessed that “this case has caused a lot of harm to many people.” – If we look at the tragedy of Andrzej Lepper's family, it (the case) has caused enormous harm – added the deputy prime minister .

Presidential Minister Małgorzata Paprocka, asked by TVN24 about pardoning former agents, replied that she would not say anything because “they are private persons”.

Negative position of the Prosecutor General

The spokeswoman for the Prosecutor General, Anna Adamiak, announced in a statement that President Andrzej Duda did not share the negative position of Prosecutor General Adam Bodnar “conveyed to the Chancellery of the President on February 8, 2024 regarding the request to apply the law of clemency to Grzegorz P. and Krzysztof B. sentenced together with Maciej W. and Mariusz K. in the so-called land scandal.

“By order of April 24, 2024, the President of the Republic of Poland pardoned the above-mentioned convicts by remitting their sentence of 1 year of imprisonment and remitting the imposed punitive measure in the form of a ban on holding positions in indicated state and local government institutions and bodies, and also ordered the expungement of the conviction,” it was reported.

It was indicated that the negative position of the Prosecutor General in this case was justified by the attitude of the convicts during the proceedings, the negation of the verdict, the legal qualification of the assigned act, the commission of acts using positions related to upholding law and public order, as well as the failure to serve any imposed sentence of imprisonment.

“The President's decision was made on the day when the District Court for Warsaw-Śródmieście in Warsaw ordered the above-mentioned convicts to be brought to prison to serve their prison sentences,” we read in the release.

Land scandal

On December 20, 2023, the District Court in Warsaw issued a final two-year prison sentence for Kamiński and Wąsik, as former heads of the CBA, for their operational activities during the “land scandal”. Meanwhile, former CBA agents Grzegorz P. and Krzysztof B. were sentenced to one year in prison.

This concerns the period from December 14, 2006 to July 5, 2007. At that time, Kamiński was the head of the CBA, and Wąsik was his deputy. The CBA received signals that the Ministry of Agriculture led by Andrzej Lepper was allegedly de-agricultural in exchange for bribes. However, there was no evidence of this.

Nevertheless, Kamiński ordered an operation to be launched and a provocation to be prepared – to create a situation in which agents with counterfeit IDs could pretend to be someone else who allegedly had a large plot of land near Mrągowo and wanted to pay a bribe for its development. As the investigation and court proceedings showed, the CBA prepared a special operation plan, which stipulated, among other things, that in the case of land de-agriculture, documents and signatures would have to be forged. The plan was accepted by Kamiński. The court later assessed that false evidence had been created for a crime that did not actually exist.

In March 2015, Kamiński and Maciej Wąsik were illegally sentenced to three years in prison and a 10-year ban from holding positions. In November 2015, President Andrzej Duda pardoned Kamiński, Wąsik and two other convicts in this case, before the verdict became final.

After the judgment from December 2023, passed in the second instance, became final, Kamiński and Wąsik were briefly imprisoned. However, before this happened, both politicians appeared at the ceremony organized by President Andrzej Duda. On January 9, 2024, police officers, in the president's absence, detained Kamiński and Wąsik at the Presidential Palace and took them first to the police headquarters and then to the detention center. Later, Kamiński was placed in a hospital cell in Radom, and Maciej Wąsik was sent to a prison near Ostrołęka.

On January 23, the president pardoned Kamiński and Wąsik. On the same day, in the evening, PiS politicians were released from prison.
