Parents: the kindergarten teacher abused the children, screamed. Defense: this is called “voice modeling”
Which is more important: the child’s welfare or the right to be defended? The court had no doubts. On Thursday, a sentence was passed in the case of a kindergarten teacher accused of beating, jerking and yelling at children. An educator with 40 years of experience, who was also supposed to prevent preschoolers from using the toilet, argued that it was an intrigue and wanted to question the children again.
In front of the District Court for Warsaw-Mokotów, on Thursday, the trial of a kindergarten teacher from the Ursynów facility “Miś Ursynek”, who allegedly abused children: beat them, shouted, yanked them.
“Oliwia became withdrawn, she returned to the pacifier. Monday visits to kindergarten were preceded by vomiting.”
“Antek was kept lying down. He couldn’t go to the toilet, so he peed on the deckchair.”
“From mid-September, Ewa did not want to go to kindergarten. She told her mother that Mrs. Krystyna was shouting in her ears that it was all her fault.”
– Raising the voice, the so-called “voice modeling”, is giving instructions to play, where the room is noisy. It is a commonly used technique of introducing discipline in the group and encouraging to play, used by many environmental teachers, not only in kindergarten or school, but also by academic teachers – Agnieszka Kańczugowska, the defense attorney of the accused, argued in the last word.
Her client, a teacher with 40 years of experience, pleaded not guilty. She argued that she had fallen victim to an intrigue. She urged that the children be questioned again five years after the report was filed with the prosecutor’s office.
Her second defense lawyer, Krzysztof Kańczugowski, said: – The essence of this case is to consider whether the best interest of the child is more important than the constitutional right to defend the accused?
The verdict was delivered on Thursday. They listened to him, holding hands, only mothers of aggrieved children and their attorney.
It started in 2017 with words that no parent of a preschooler wants to hear: “Take a good look at your children, because something is wrong.” The signal was given by one of the carers working in the kindergarten in Kabaty. No wonder that the parents looked at the behavior of toddlers differently, who did not want to go to kindergarten, were terrified of lying down, were hypersensitive to sounds.
