On Thursday, August 31 this year, the exemption from tax on civil law transactions (PCC) for the purchase of the first apartment or house will come into force. This will apply to the secondary market. – This is a huge saving – commented Minister of Development and Technology Waldemar Buda on Radio One.

The exemption from PCC for the purchase of the first apartment will apply under the Act of May 26, 2023 amending the Act on municipal self-government, the Act on social forms of housing development, the Act on real estate management, the Act on tax on civil law transactions and certain other acts. The regulations were published in the Journal of Laws on July 31. The provisions regarding PCC come into force one month after the announcement.

Tax free

The Ministry of Finance indicated that the sales that are exempt from tax on civil law transactions will be the following: ownership right to a residential premises constituting a separate property, ownership right to a single-family residential building or cooperative ownership right to the premises relating to a residential premises or a single-family house.

The exemption will apply if the buyer is a natural person or natural persons, and none of them was entitled to the right to the apartment or house on the date of purchase and was not entitled to any of these rights or participation in these rights before that date.

The exception applies to persons who, on the date of conclusion of the sales contract, have or before that date had an interest in such rights, but it does not exceed or did not exceed 50%. and was acquired by inheritance. These people may benefit from the exemption, the Ministry of Finance informed.

The Ministry emphasized that the exemption will enter into force on August 31, 2023 and will not cover sales made before that date.

What are the amounts? In the case of a flat worth 300,000 PLN PCC is PLN 6,000, and the premises are valued at PLN 500,000. – 10 thousand zloty.

– This is a huge saving, which is why many people refrained from buying a flat and only looked for apartments in… primary market. Now it will also be a search on the secondary market because there will be big savings – said Minister Waldemar Buda on Radio One.

The Ministry emphasized that the exemption will enter into force on August 31, 2023 and will not cover sales made before that date.
