The application for surveillance with the Pegasus program of the senator of the Civic Coalition Krzysztof Brejza was signed by trusted people of the Minister of Justice Zbigniew Ziobro. According to Citizen Lab senator Krzysztof Brejza was under surveillance 33 times before the parliamentary elections in 2019, when he was the head of the KO electoral staff.

“Gazeta Wyborcza” reported on Friday that it had reached a conclusion that allowed the surveillance of Brejza in 2019. As the author of the publication Michał Kokot wrote, “it was submitted by the then deputy head of the CBA Grzegorz Ocieczek”. “He is a retired prosecutor, a member of the ‘Ad vocem’ association, which includes people close to the Minister of Justice and the Prosecutor General Zbigniew Ziobro” – emphasized.

As the newspaper wrote, “Ocieczka’s application was personally approved by Bogdan Święczkowski, then the national prosecutor and deputy prosecutor general.” It was emphasized that both were PiS candidates in the past in local and parliamentary elections.

Since February 2022, Święczkowski has been a judge of the Constitutional Tribunal.

“Wyborcza” pointed out that “the CBA wanted to invigilate Brejza Pegasus for three months, but the court granted permission for only a month.” “However, it is known from the report of the Canadian organization Citizen Lab that the senator’s operational control lasted much longer – from April to October 2019” – added.

The newspaper also cited Senator Brejza’s comment. – The elections in 2019 were conducted by PiS services. We are beginning to suspect that the court’s consent to the operational control was extorted. It’s a warning of what could happen in this year’s election. It’s a perfidious attempt to blacken my dad at the end of this whole operation. We intend to counteract these dirty practices of the contemporary Law and Justice Security Service – he said.

The prosecutor in charge of the investigation resigned

“GW” emphasized that it was a pretext for the surveillance of the opposition politician invoice scandal in Kruszwica and Inowrocław, where 19 people were charged in the investigation. In this case, Ryszard Brejza – as the president of Inowrocław – is a victim. But the Gdańsk prosecutor’s office also announced to him allegations of abuse of authority and failure to perform duties. This issue was excluded by the prosecutor’s office for a separate proceeding. As part of the invoice investigation, witnesses are also questioned about Krzysztof Brejza.

According to unofficial sources in the prosecutor’s office, the disclosed documents confirm the use of Pegasus against Krzysztof Brejza. The information was also confirmed by TVN’s “Superwizjer” journalists in other sources close to the case.

In connection with this case, Teresa Rutkowska-Szmydyńska, head of the Regional Prosecutor’s Office in Gdańsk, was summoned to the National Prosecutor’s Office on Wednesday. This prosecutor’s office supervises the investigation into the invoice scandal in Kruszwica and Inowrocław.

After resigning from Wednesday, prosecutor Kierski is on sick leave – the journalists of “Superwizjer” TVN established.

The head of the prosecutor’s office signed the summons

So far, cases of Pegasus surveillance in Poland have been reported – independently – by the Citizen Lab and Amnesty International. On the list, apart from Brejza, there is a patron Roman Giertych, prosecutor Ewa Wrzosek and the head of Agrounia Michał Kołodziejczak. In April 2022, Citizen Lab reported that Andrzej Malinowski, the former president of the Employers of Poland organization, joined this group.

In January 2022 Krzysztof Brejza sued Jarosław Kaczyński for not only confirming in a press interview that the Polish services have the Pegasus surveillance system, but also suggesting that Brejza is under serious suspicion. However, he did not specify what the suspicions were. Since no proceedings were pending against Brejza, the opposition senator regarded this statement as slander.

A few hours after Krzysztof Brejza submitted the notification, to the building of the city office in Inowrocław Two officers of the CBA arrived and handed the father of Senator KO Ryszard Brejza an envelope with a letter inside – a summons to the prosecutor’s office.

Reasons for summoning the mayor of the city

Later, Grażyna Wawryniuk, press spokeswoman for the District Prosecutor’s Office in Gdańsk, explained that it was an investigation regarding, among other things, the abuse of powers by public officials – employees of the Department of Culture, Promotion and Social Communication of the City of Inowrocław and the Ziemowit Center for Culture and Sports in Kruszwica, consisting in extortion of several hundred thousand zlotys from public funds.

“Based on the collected evidence, it was established that from 2015 to 2017, employees of the Department of Culture, Promotion and Social Communication of the City of Inowrocław and the Ziemowit Culture and Sports Center in Kruszwica, acting in order to achieve a financial benefit, exceeded their powers in such a way that by using attesting untruths and counterfeit invoices, some of which were issued by selected entrepreneurs, led to the payment from public funds of the mentioned budgetary units for services that were not performed or were provided to another entity, “Wawryniuk said in the message sent.

She added that in these proceedings, 18 people were charged with committing over 250 crimes, and the case itself is still developing. “The prosecutor’s office summoned Mr. Ryszard B. as a suspect in order to present the charge of committing an act specified in Article 231 § 1 and 2 of the Penal Code” – summed up Wawryniuk.

The case of inflated invoices

Since 2015, the anti-corruption service and the prosecutor’s office have been investigating a case involving the withdrawal of several hundred thousand zlotys from the city’s coffers using false invoices. The main suspect in this case is an official of the Inowrocław magistrate, Agnieszka Ch. As the head of the culture department, she accepted all invoices questioned by the CBA, most often with an inflated value or for services not performed.

Ryszard Brejza reported to the prosecutor’s office after an inspection carried out in the division headed by Agnieszka Ch.
