Penalty points 2023. Courses reducing penalty points are back – President Andrzej Duda signed the law

Further changes in the Road Traffic Act are becoming a fact. Penalty points will be removed again after one year, not after two years. Courses reducing penalty points, carried out by provincial road traffic centres, will also return. President Andrzej Duda signed the law on this matter.

President Andrzej Duda on Tuesday signed the Act of May 26, 2023 amending the Act – Road Traffic Law and some other acts. Office of the President of the Republic of Poland announced in a statement that the Act amends, inter alia, article 98 of the Act of January 5, 2011 on vehicle drivers.

Penalty points 2023 – changes

According to the changes introduced, information on the number of points received in the central register of drivers will come from it deleted after 1 year, and not as before – after 2 yearsThis means that the new regulations restore the legal situation from before 2022.

According to the amendment to the Driver’s Road Traffic Law maximum once every six months, they will also be able to take part in a paid training, which will reduce 6 penalty points. “(…) a person entered in the register of drivers, not more often than once every 6 months, will be able to participate in a training at their own expense, excluding the possibility of training using means of distance communication, the completion of which will result in a reduction in the number of points for violation traffic regulations,” the statement reads.

The KPRP explained that for a person entered in the register, after presenting a certificate of training completion or receiving this certificate from the director of the voivodeship road traffic center, the voivodeship police chief competent for the place of residence of that person will reduce the number of points held by 6, subtracting them according to the order of entries, starting from the entry corresponding to the infringement committed on the earliest date.

The odds reducing penalty points disappeared on September 17, 2022. Taking a 6-hour course with the participation of a policeman and a psychologist was the basis for reducing the number of penalty points by 6. The course cost several hundred zlotys.

Taxi via apps

The amendment is also intended to increase the safety of passengers in transport via the application, e.g. by better than before verification of the driver’s identity. Entrepreneurs acting as intermediaries in road transport will be obliged, among others, to: to verify drivers who perform transport before starting cooperation and ordering the first transport.

It will be mandatory to check: identity, possession of an appropriate license to drive a car and no criminal record for crimes against life and health and against sexual freedom and decency, as well as for crimes referred to in Art. 59 of the Act of July 29, 2005 on counteracting drug addiction, and the lack of a final judgment banning the driver’s profession.

“Verification will take place by presenting by the person to whom the entrepreneur commissions the transport of people an identity document, a document confirming the possession of the appropriate license to drive a car and a certificate of no criminal record issued not earlier than one month before the start of cooperation” – we read.

According to the amendment, you will not have to pay the registration fee, e.g. for vehicle registration; issuance of a registration certificate, temporary permit and legalized plates; conducting a technical inspection of the vehicle and reading the odometer of the vehicle after replacement. The registration fee is PLN 0.50 or PLN 1.

The Act “abolishes the obligation to pay a registration fee for official activities related to the movement of vehicles, with the exception of registration fees paid by insurance companies”.

Entry into force

The Chancellery of the President of the Republic of Poland announced that the act will enter into force on the first day of the month following the month of its publication. However, as noted, a significant part of the provisions will enter into force on later dates or on dates specified in the announcements of the minister competent for computerization specifying the date of implementation of individual technical solutions.
