President Andrzej Duda should not exaggerate, he is not a medieval ruler, he is not an absolute ruler, he is bound by the provisions of law – said Piotr Zgorzelski (PSL), Deputy Speaker of the Sejm, in “Fakty po Faktach”, commenting on the words of the head of state that he would not allow verification judges appointed during his presidency. – People gave us a very strong mandate to change the justice system. And we will do it, said Katarzyna Piekarska (KO).

President Andrzej Duda declared on Sunday that will not allow “any verification of judges” appointed during his presidency. As he added, “these are people who went through the entire procedure preceding joining the judicial ranks or being promoted.” – They were appointed in accordance with the regulations, took oaths before the president, and received nominations. I will not allow these people to be verified and persecuted, he said.

Zgorzelski emphasized that in order for someone to be effectively appointed judge, two cumulative conditions must be met.

– The first premise is the request of the National Council of the Judiciary. The second one is the president’s decision. And if the first premise is defective, because there is no National Council of the Judiciary that could effectively present a candidate, because it was appointed contrary to the constitution, then the second premise eliminates the correctness and effectiveness of the appointment of all these neo-judges – explained the Deputy Speaker of the Sejm.

He repeated. that Andrzej Duda “is not emperor”. – Really, Mr. President, don’t be so proud of this prerogative – he said.

“It cannot be that the prosecutor’s office acts on a political whistle”

– People gave us a very strong mandate to change the justice system. And we will do it, announced Katarzyna Piekarska (KO).

She added that “an act that will separate the functions of the prosecutor general from the minister of justice will soon be submitted to the Sejm.”

– It cannot be that the prosecutor’s office is concreted, acts on political whistles and sweeps all inconvenient matters under the carpet. No more, there are simply no sacred cows. Whether you are a high official, a nurse, a doctor, a cleaner, a high politician or the president, you will respond in the same way – said Piekarska.

Zgorzelski: the end does not justify the means, you have to pay a penalty for the abuse of power

On Friday PiS president Jarosław Kaczyński went to the prison in Przytuły Stare (Masovian Voivodeship), where Wąsik is serving a prison sentence. Referring to the case of the convicts, he said to another PiS politician loudly that it was recorded by cameras, including the camera of “Fakty” TVN: – I hope that the president will make up his mind and finally free himself. – With the method he used, it could last another year – he added.

– I wonder what an average citizen, an ordinary Pole, thinks about all this. Well, the idea is: if you are a PiS activist, the president will pardon you out of turn. Because from what I know, an ordinary citizen who can write to the president’s office has to wait over a year for a pardon. And the president of the party will absolve him, because Mr. Kaczyński said that this verdict is scandalous, this verdict should not be passed – said Piotr Zgorzelski.

– Well, this sentence should have been passed because it concerned a crime called abuse of power – he added. He pointed out that “in many democratic countries, abuse of power has a very high penalty threshold, so in our country, two years is really not a big deal.” He emphasized that in a democratic country “the end does not justify the means and one must simply pay a penalty for the abuse of power, initiating and arranging corruption incidents.”

Zgorzelski expressed the opinion that naming Kamiński and Wąsik political prisoners is scandalous. – This is simply unacceptable, because political prisoners are subjected to all the methods that Mr. Wąsik and Mr. Kamiński used. They used the methods to which he was subject Andrzej Poczobut. In a letter to his wife he wrote: we do not choose the times in which we live, but we choose how we live in these times. Poczobut is in prison for freedom, for democracy, for being a Pole. So the equal sign between these people is completely unacceptable and I do not consent to it – said the Deputy Marshal.

“It would be good for Mr. Kamiński and Wąsik to start getting used to prison cells”

Piekarska said that “Kamiński and Wąsik are criminals.” She emphasized that these were not “common criminals”.

– If a common criminal steals your wallet or breaks a window, he will be punished. They did something much worse, because while performing such important functions, it is an abuse of power and it should be branded with iron, so that no one who will be in power after them, and also after this government of ours (..) would not think of something like that – she said.

The MP said that when she listened to Tomek’s agent, she had the impression that “this is not their last trial.” – And it would be good for Mr. Kamiński and Wąsik to start getting used to prison cells, because next time there will be no one to pardon them – she added.

In Piekarska’s opinion, “exciting this political emotion paradoxically plays into the hands of Law and Justice.” – You have to ask yourself why the president chose this longer path (of pardon – ed.)? Although he could have shortened it significantly. For some reason, he chose the path from criminal procedure, from the Code of Criminal Procedure. This means that certain conditions must be met, she said.

According to her, both Maciej Wąsik, as well as Mariusz Kamiński, “are currently fuel for PiS.” – Because you can come to the prison and shout that they are political prisoners – she said. – This is truly a shame and disgrace, because real political prisoners simply suffer torture in prison – she added.
