Poland was covered by the European Commission with the second stage of the procedure for violating the rights of the European Union. The reason is the lack of presentation of Brussels with an updated energy and climate plan. If our government does not do it in the next two months, then the Commission may direct a complaint to the Court of Justice of the European Union (CJEU).

Until now, the Commission has received 22 final plans. In addition to Poland, the EC called for the final updated domestic plans for energy and climate also Belgium, Estonia, Croatia and Slovakia. The deadline for submitting new plans was June 30, 2024.

In these plans, Member States explain how they want to pursue the Union's climate goals. Countries submitted such documents, determining the assumptions of their policy in the perspective of the current decade, in 2019 Niemiej, in connection with the European green order and the “Fit for 55” package, raising the purpose of reducing greenhouse gas on 2030 (55 % compared to 1990), the countries had to update their obligations.

Two months to answer the European Commission

Poland and other countries called to catch up have two months to answer the EC. Otherwise, the Commission may decide to refer cases to the Court of Justice of the EU.

The Ministry of the Climate is responsible for the preparation of the updated Poland of Poland, which – after supplementing the document package with the project of environmental impact forecast – extended public consultations by the end of February this year.

In January, Deputy Minister of the Climate and Environment, Urszula Zielińska, said that at the end of February the plan would be directed, among others under the deliberations of the Government Committee for European Affairs.

The government is to choose a script or so -called base or ambitious. After completing government work, the document is to be sent to Brussels at the latest in June 2025.

This is not the first such situation

The EC has already conducted proceedings for a violation of Poland in connection with failure to comply with the deadline for submitting a project to an updated plan at the turn of 2023 and 2024.

After receiving the EC project, she closed the proceedings, but in her opinion of the Polish plan, she asked the Polish authorities to raise the decarbonization goals to 2030.

European Union climate policy

The agreement that in the EU greenhouse gas emissions will be limited by 55 percent. By 2030, it fell at the EU summit in Brussels at the end of 2020. Therefore, in July 2021 European Commission She presented the Fit for 55 legislative package. At the end of April 2023, the Council of the European Union adopted five key legal acts.

Fit for 55 is a package of climate and energy laws that are to change or update EU regulations. It is part of the European Green Ladu, presented at the end of 2019, which is designed to “transform the EU into a modern, resource -saving and competitive economy”, as we read on the European Commission website. One of the assumptions of the green order is zero emission, to which Fit for 55 is to contribute.
