The court in Lisbon ordered a urban transport company to pay EUR 25,000 to the wife of a man injured in an accident. The 38-year-old suffered extensive injuries, as a result of which he lost his sex drive. “This was directly affected by their marriage life,” was found in the ruling.
The Carris urban transport company was obliged to pay compensation to the spouse of a man who, as a result of a tragic event, lost his sex drive. Court in Lisbon, the capital Portugalsaid that the company in which the injured person worked during an accident must pay his wife 25,000 euros (about 10,000 zlotys). Portuguese media reported on Tuesday, including CMTV television.
The man fell off the roof and suffered numerous injuries
A tragic event occurred in 2014, when a accident occurred while working on the renovation of one of the buildings of Carris. The man fell off the roof and suffered numerous injuries. The case file shows that the injured party suffered due to the lack of required security, which was to be provided by the company's authorities at the renovated facility.
The Court of Appeal in Lisbon ruled that the accident directly influenced the marriage life of the couple. The ruling was considered that the loss of libido by her husband was a “moral loss” subject to compensation. “As a result of the accident, the wounded wife also suffered damage (…), it directly influenced their marriage life,” it was said.
The court also upheld the decision to grant a man compensation in the amount of EUR 120,000 (approx. PLN 500,000). “The intensity of felt pain and discomfort, the period in which it was and will be subjected to procedures and consultations, injuries and total dependence on third parties – such damage is undoubtedly very serious, and the amount desired is not excessive” – justified in the ruling.
