Power engineering. The President signed the amendment to the Consumer Protection Act

President Andrzej Duda signed an amendment to the act on the protection of electricity consumers, the president’s office announced on Wednesday. The amendment raises the consumption thresholds for which household consumers are entitled to frozen energy prices.

Office of the President of the Republic of Poland announced in a statement Wednesday that the president Andrzej Duda signed the act amending the act on special solutions for the protection of electricity consumers in 2023 in connection with the situation on the electricity market and certain other acts.

Higher wear thresholds

In 2023, this amendment raises the consumption thresholds to which household consumers are entitled to frozen energy prices. According to the new regulations, the limit will increase: for households from 2000 kWh to 3000 kWh per year; for households with a disabled person, from 2600 kWh to 3600 kWh; for holders of the Large Family Card and farmers – from 3,000 kWh to 4,000 kWh per year. The new limits will be available in 2023, even if the electricity consumer has exceeded the current limit. However, the deputies rejected the Senate’s proposal to raise the consumption limit to 6 MWh for heat pump users.

The amendment also provides that from October 1, 2023, the maximum price for energy will be reduced – from PLN 785/MWh to PLN 693/MWh. This will concern: local governments; small and medium enterprises; sensitive public utility entities, such as hospitals, schools, kindergartens, nurseries, night shelters and care facilities for the disabled.

The Ministry of Climate and Environment estimated that the additional total cost resulting from the increase in limits and the reduction of the maximum price will amount to approx. PLN 3 billion. The total effects of the defense mechanisms, including the mechanism in the amendment, are to amount to PLN 39 billion 711 million.

New regulations for gas companies

The Act also contains a provision on the gas sector. It assumes that a natural gas extraction company whose liabilities are covered by a State Treasury guarantee under the Act on Special Solutions for the Protection of Gas Fuel Consumers in connection with the situation on the gas market, increases a one-off contribution to the Price Difference Payment Fund by the amount of the compensatory fee. The equalization fee is paid by the enterprise together with the gas contribution to the Price Difference Payment Fund due for the month following the month of entry into force of the Act.

The Act enters into force after 14 days from the date of publication, with the exception of some provisions that enter into force on a different date.
