Amendment to the Judicial Act

The amendment to the law on the Supreme Court, the draft of which was submitted by PiS deputies, is, according to the authors, to complete a key “milestone” for the European Commission to unlock money for National Reconstruction Plan. Among other things, it stipulates that disciplinary and immunity cases of judges are to be resolved The Supreme Administrative Court, and not – as at present – the Chamber of Professional Responsibility of the Supreme Court. The amendment also provides for fundamental changes regarding the so-called test of independence and impartiality of a judge.

The Sejm passed an amendment to the law on the Supreme Court on January 13 this year. At the end of January, the Senate introduced 14 amendments to it, which were rejected by the Sejm last Wednesday. Then the amendment went to the desk of President Andrzej Duda.

The president said in Friday’s address that he was and is a supporter of compromise. – It is important to me to activate the funds from the National Reconstruction Plan as soon as possible, which are needed for the development of the Polish economy – he said. – That is why I did not decide to veto the amendment to the law on the Supreme Court, which was passed by the Polish parliament in recent days – he informed.

– But as the President of the Republic of Poland, I uphold the constitution and care for the legal security of citizens. So I decided to refer this bill to the Constitutional Tribunal – under the preventive control procedure – said the president.

As he pointed out, “the provisions of this act touch on fundamental systemic issues, including the stability of the judiciary and the judgments it has issued over a number of years, which are issues that are very important for citizens.” – That is why the Constitutional Tribunal should clearly resolve all doubts, as the only entity authorized to do so – said Duda.

He assessed that “in practice, this will not delay the payment of funds from the KPO for Poland, because for this it is necessary to take further actions and decisions, including further legal acts, which are provided for in the agreement concluded by the government with the European Commission – which takes time anyway.”
