President of the NRA: We live in a time when even the audit of a witness is a political matter

– In the context of the upcoming elections, I consider it completely unreal that the reform of the judiciary can be carried out in the summer – in July, August or September. It's simply a fantasy – says in an interview with tvn24.pl lawyer Przemysław Rosati, president of the Supreme Bar Council.
Piotr Szostak: We live in a country where three thousand judges – according to leading legal authorities – pretend to be judges. Constitutional Tribunal This is a tragicomedia – the courts do not recognize his judgments. The government, in turn, does not recognize one of the chambers of the Supreme Court. I would like you to help me a little better in this.

In recent years, the Constitutional Tribunal has successfully changed its authority into small. Today, it is very difficult to identify some positive social trust in this institution. And specific people are always behind trust – their actions, decisions, credibility, as well as what and how they did in the past.
The problem is that those who came to the Tribunal after 2015 meant that he was not realistically guarding the protection of civil rights and freedoms. This is the essence of the problem. This is the main role of the Constitutional Tribunal – a control of the constitutionality of acts of law established by public authorities. And TK almost does not take care of it. This is a situation that directly hits ordinary people and is generally on the hand of politicians. The Dysfunctional Constitutional Tribunal is in the interest of every power, because its actions are then beyond real control. This is obvious and unfortunately takes place in Poland. To the detriment of ordinary people.

There are no instruments today that allow you to defend yourself against an unfair or erroneous law?
The constitutional complaint is a tool that the constitution gives a citizen to, in general, after exhausting all possibilities in court proceedings – could question the provision on the basis of which the ruling unfavorable for him. This mechanism stopped working. But instead, there were, for example, quick paths of adjudication in matters …
… very political.
And this is an abnormal situation.
The judges of the Constitutional Tribunal earn PLN 40,000 gross a month, although they do not really do much today – three have retired, and the Sejm did not appoint successors. In February, the rulers stopped their payments. Is it not a low play?
