Prof. Ewa Łętowska in “Fakty po Faktach” about the Supreme Court and restoring the rule of law

Democracy is such that the rule of law operates within the framework of a situation that is also shaped by politics. Is this pace satisfactory to us? Certainly not. Could it be better? Probably yes – said Professor Ewa Łętowska about the pace of restoring the rule of law in “Fakty po Faktach”. She said that “one good thing at the moment is – watching the hands and paying attention”.

Professor Ewa Łętowskaretired judge of the Constitutional Tribunal, former Ombudsman admitted in “Fakty po Faktach” that the situation in the Supreme Court is complicated.

– The Supreme Court is indeed divided, I don't want to say camps, because that sounds bad, but the situation of different groups of judges is different. There is a group that knows the law, knows how to behave, knows what they can do for themselves, currently has support from the same community, so in connection with this, let them use the opportunities that are at their disposal – said the guest of “Fakty po Faktach”.

Prof. Łętowska also referred to an open letter she signed addressed to Prime Minister Donald Tusk. It stated that granting a countersignature led to a slowdown in the march towards the rule of law.

– If countersignatures are given to judges whose participation in adjudication is classified as staffing a court that does not have the characteristics of independence, and judges are not independent, then (restoring the rule of law – ed.) goes slower because the opportunity was not used – she said.

“Is this pace satisfactory? Certainly not”

Asked whether the restoration of the rule of law is going too slowly, Prof. Łętowska said that “there are certainly many situations in which something more could have been done”. – But I understand perfectly well that whether in the position of prime minister or in general in the position of various ministers, they are entangled in various situations, including political ones, resulting from political alliances or difficult cohabitation, she said.
