The prosecutor's office has filed a motion to exclude a judge appointed by the neo-NCJ to the case of Marcin Romanowski. – The prosecutor's office has the right to do so, and each party to the proceedings has the right to file a motion to exclude a judge. The court will decide in this regard. I believe that the motives and reasons for this motion are very, very serious – commented Marcin Kierwiński (KO). In the opinion of PiS MP Paweł Szrot, the motion “is completely groundless”.

PiS MPformer Deputy Minister of Justice Marcin Romanowski was detained in connection with an investigation concerning the Justice Fund. He was charged with 11 counts. He was released when the District Court for Warsaw-Mokotów rejected a motion for detention. The reason for the court's decision – as reported – was Romanowski's immunity as a member of the Parliamentary Assembly of the Council of Europe.

On August 2, the spokeswoman for the Prosecutor General, Prosecutor Anna Adamiak, told TVN24 that the prosecutor's office had filed a motion to exclude the judge from the case of Marcin Romanowski, who was drawn to consider the appeal.

As she stated, “this is a judge elected by the National Council of the Judiciary, formed recently”. As OKO.press reported, a judge was appointed to the case Judge Przemysław Dziwański of the 10th Criminal Appeal Division of the District Court in Warsaw.

Kierwiński: if there are any indications that the judge could have been in a close relationship with Romanowski, he should be excluded

The MEP from the Civic Coalition commented on the matter on Wednesday. Marcin Kierwinski– The prosecutor's office has the right to do so, and each party to the proceedings has the right to file a motion to exclude a judge. The court will decide in this regard. I believe that the motives and reasons for this motion are very, very serious – he said.

– Mr. Romanowski was the deputy minister of justice, he participated in the process of destroying the Polish justice system. (…) If there are any indications that the judge dealing with Romanowski's case could have been in close relations with Romanowski at some point or that Romanowski, as the deputy minister, helped him in some matter, then I believe that he should be excluded – Kierwiński believes.

Paweł Szrot from Law and Justice has a different opinion on the subject, calling the prosecutor's motion “political pressure”. – This is completely unfounded in my opinion. This is an attempt to exert political pressure on the court ruling in this case. (the motion – ed.) should be rejected. What will happen? I am not able to predict – he said.

– I see in this matter some unhealthy drive to put an opposition MP behind bars and Minister Bodnar is heading in that direction relentlessly. (…) MP Romanowski is ready to explain all the charges brought against him all the time. He appeared at the prosecutor's office, he was not questioned there despite his personal appearance. He was arrested, then he was unlawfully in front of cameras. This is simply a political attack, I have no doubts – says Szrot.
