One of the policemen involved in the police car accident in Dawidy Bankowe near Warsaw was to appear in court on Friday. However, the prosecutor did not read the indictment because a change of judge would be necessary. The proceedings against the second policeman were previously discontinued.

The accident occurred at the beginning of last year. Police officers from Pruszków then received a report about a fire. Driving away from the scene, they took two teenagers from the group that reported the fire to the police car. A moment later, in Dawidy Bankowe near Warsaw, the policeman driving the police car – Janusz R. – lost control of the car and hit a tree.

The first hearing in this case took place on Friday at the District Court in Pruszków. The event was attended by a former officer and injured teenagers with their guardians and attorneys. The hearing was held in public.

The former officer's representative, attorney Jolanta Turczynowicz-Kieryłło, informed that she had submitted a motion to exclude Judge Aneta Bownik from adjudicating due to doubts related to the fact that the judge issued a penal order in another case related to the case of Janusz R. – This is a procedural reason why it is necessary to check whether the judge can rule on the case. The importance of this problem is serious, which is why the prosecutor and the subsidiary prosecutor also agreed to this request, emphasized lawyer Turczynowicz-Kieryłło.

The District Court in Pruszków considered the application and issued a decision to exclude the judge from adjudicating in the case. – This concerns justified doubts about the judge's impartiality. (…) Therefore, a new randomly selected judge and new trial dates will be appointed – said Turczynowicz-Kieryłło.

“They were supposed to get into the police car voluntarily”

The indictment against former officer Janusz R. was brought to court by the District Prosecutor's Office in Warsaw in July last year. R. was accused of exceeding his official powers. He took two teenage girls into a police car and then crashed the vehicle. The girls were injured.

Investigators confirmed that no official actions were taken against the teenagers, and they were supposed to get into the police car voluntarily.

– The indictment also included an accusation of an offense committed by Janusz R., which consisted in failing to fulfill the duties of a police officer by failing to provide assistance to women injured in an accident – explained Prosecutor Szymon Banna from the District Prosecutor's Office in Warsaw.

The former policeman faces three years in prison.

The proceedings against the second officer were discontinued

The second policeman involved in the incident was charged with failing to fulfill his duties by failing to provide assistance to victims of the accident.

The prosecutor's office noticed the man's “secondary role” in the incident. The man's attitude during the preparatory proceedings was also taken into account. Therefore, the court submitted an application for conditional discontinuation of criminal proceedings. The policeman had to apologize to the victims and pay them compensation. The court agreed to this request and the proceedings took place in October last year. has been written off.
