According to investigators, the former president of one of the banks in Przemków (Dolnośląskie) and three former board members of this facility for 15 years were to lead to losses of over PLN 111 million. All four were arrested and charged.
According to the National Prosecutor’s Office, the former president of one of the banks in Przemków Janina P. and three former members of the management board – Teresa U., Anna M. and Marek B. – were detained by the Wrocław police on the order of the District Prosecutor’s Office in Legnica, which was conducting the investigation.
The investigation covers the years 2003–2018. “As it was established, the president and members of the management board caused damage to the bank’s property in the amount of over PLN 111 million. The president of the bank and management board members, while pursuing a defective credit policy and improper organization of work, violated their powers and failed to fulfill their obligations” – informed the prosecutor’s office.
Prosecutor’s Office: acted on behalf of the bank, but did not analyze or verify
According to the prosecutor’s office, the suspects, acting on behalf of the bank, concluded loan agreements with customers without a detailed analysis of the borrowers’ financial forecasts, without analyzing the correctness of the data provided by the borrower and without verifying the creditworthiness of the guarantors.
“At the bank (…) more loans were granted to customers who had problems with timely repayment of previous liabilities to the bank – in the mechanism of the so-called ‘loan rollover’, which means that the previous loan was repaid with the newly granted loan” – stated in the release.
The investigation also established that the bank’s accounting books were kept in violation of the provisions of the Accounting Act. As indicated in the release, the books contained unreliable data, which overstated the bank’s financial results.
“Illegal debits were created on the accounts of borrowers in such a way that fictitious loan repayments were manually posted according to the schedule, resulting in unauthorized debits on the current accounts of borrowers, and then the resulting debits were covered with a loan from a new loan agreement” – PK informed.
Threat of high penalty
The detainees were charged with causing damage to the bank’s property in the amount of over PLN 111 million.
All suspects were subjected to preventive measures in the form of bail, a ban on leaving the country and police supervision.
Moreover, Marek B., who is currently employed as the credit director of one of the cooperative banks, was suspended from his duties.
Towards Anna M., who runs a business in the field of credit intermediation, the prosecutor applied the order to refrain from running a business in the field of credit intermediation, banking, financial and insurance services.
The suspect is facing up to 10 years in prison.
