Judge Leszek Pietraszko justified that the evidence gathered does not raise doubts about the incident of the accused. He referred to the opinions of experts, which show that the unlucky day was disconnected the gas stove from the gas network by unscrewing the connection of the pipe with the stove. “This caused a violent gas outflow. Because the thread was not violated, therefore the conclusion was obvious that this cable was unscrewed, and not that the stove was broken or torn out of the installation as a result of an explosion (…). Since it was established that it was established that it was established that it took place For such interference, and as soon as the accused was in this apartment (on the first floor), the logical application is obvious that only the accused could do it ” – explained the judge.
According to the court, the woman is responsible for unscrewing the gas supply cable, but at the same time he noted that its purpose was suicide by poisoning with gas, and not as a result of causing an explosion. The Court of Appeal shared the position of the Court of First Instance that there is not sufficient evidence to assign Anna T.'s intentionality as to the prediction and reconciliation of further effects, i.e. the collapse of the house and the death of people on the ground floor.
