The prosecutor’s office is investigating the circumstances of a tragic incident in the village of Pyzówka in the Nowy Targ district (Lesser Poland Voivodeship), where a 12-year-old driving a quad died. The accident happened when the boy went on a four-wheel trip in the forest.

The tragedy happened on Wednesday (July 5) in the village of Pyzówka in the Nowy Targ district. In the evening, the body of a 12-year-old boy was found in a hard-to-reach areawho, according to police findings, had gone on a trip to the forest a few hours earlier on a quad bike. The child’s body was found by his parents, who – concerned about their son’s prolonged absence – started looking for him.

– Most likely, the teenager, entering the hill, lost control of the vehicle and led to its overturning. The overturning vehicle hit a boy who was not wearing a helmet, reported the spokeswoman for the Nowy Targ police, Dorota Garbacz.

ATV for a child. What do the regulations say?

It happens that children receive a gift from their relatives on the occasion of celebrations such as First Holy Communion in the form of a quad bike. According to the regulations, however, this is a much too young age for the first independent rides on a four-wheeler.

Remember that these four-wheelers are not a toy. Vehicles of this type must also be registered and the person driving them must be licensed to drive. We urge you to be considerate and careful. The technique of driving a four-wheeler is specific and it is very easy to overturn, and from there it is only a step to a tragedy.

Quads, depending on several variables, can be treated according to the regulations as either quads or light quads. Quadricycles are motor vehicles (excluding cars, trucks and motorcycles) designed to transport people or things. If the vehicle is carrying people, its curb weight must not exceed 400 kilograms. If things – 550 kilograms.

On the other hand, a light four-wheeler is a vehicle whose curb weight does not exceed 350 kilograms and its maximum speed does not exceed 45 km/h.

Each such vehicle moving on public roads, in residential areas or traffic zones should be technically efficient, registered and insured in terms of third party liability, and the driver of such a vehicle must have the appropriate qualifications.

In the case of a quadricycle, a driving license of category B1 or B is required. The first one can be obtained at the age of 16, the second – at the age of 18. The requirements for a light quadricycle are less restrictive. The driver should have at least an AM driving license, which replaced the former moped card. You can apply for these rights at the age of 14. Younger people should not drive any ATV.

Holders of driving license category B1 or B can drive quads of any power and engine capacity.

“If a child causes a real threat to human life and health by driving such a vehicle with the consent of parents or other adults, such persons expose themselves to criminal liability, as provided for in Article 96 of the Code of Petty Offenses and Article 160 of the Penal Code. This may result in a penalty of up to 3 years in prison.

Riding with a child on a quad, safety measures

However, children may accompany drivers as passengers, however, if a child under the age of seven is transported, the speed of the quad cannot exceed 40 km/h.

Regardless of the age of people riding a quad, remember that if the vehicle does not have a closed body and seat belts, it is absolutely necessary to use protective helmets while driving.

“Not all wilderness can be conquered by quad bike – for example, in national parks it is allowed to drive only on public roads and on designated routes. Breaking the ban is punishable by imprisonment for up to 30 days or a fine of up to PLN 5,000. You also need to pay attention to the signs set up by the forests – it often happens that they restrict the freedom of vehicle movement on them.

Quad bikes are also not allowed on motorways and expressways.
