An audit of the legality of employment of foreigners was conducted at a temporary employment agency belonging to a 40-year-old Ukrainian citizen. It lasted almost nine months. It ended with a finding of “serious violations” and an announcement that the application would be filed with the court.
Officers of the Employment Legality Control Team from the Border Guard Post in Radom checked whether the owner of the employment agency entrusted legal performance of work and foreigners performed it legally, without violating the provisions of the Act on Employment Promotion and Labor Market Institutions.
They checked a total of 191 foreigners, including citizens of Ukraine, Belarus, Cuba, Moldova and Georgia, whom the agency employed mainly as cleaners or meat processors in the Mazowieckie and Łódź voivodeships.

Application to court
– The result of the completed inspection was that Border Guard officers found serious violations both on the part of the owner of the temporary employment agency, who entrusted illegal work to 78 foreigners, and on the part of 67 foreigners who worked illegally – informs Dagmara Bielec, press officer of the Nadwiślański Border Guard Unit. – A motion will be filed with the court against the owner of the temporary employment agency in connection with the offenses committed – she adds.
The penalty is a fine of up to PLN 30,000.
1. Whoever entrusts a foreigner with illegal work shall be subject to a fine from PLN 1,000 to PLN 30,000. 2. A foreigner who performs work illegally shall be subject to a fine.
71 inspections since the beginning of the year
Since the beginning of the year, officers from the Border Guard Post in Radom have conducted 71 checks on the legality of employment, covering 854 foreigners. As a result of the checks, 176 cases were recorded in which employers illegally entrusted work to foreigners.
In turn, 129 foreigners worked in Poland illegally. They worked without the appropriate permit or performed work on conditions other than those specified in the permit or without concluding the required contracts.
