Rafako bankruptcy. Minister about help for the company

Help for Rafako is still possible, talks are underway in this matter – said state assets minister Jakub Jaworowski. The District Court in Gliwice issued a declaration of bankruptcy of the company in December last year.

– Help for Rafako is still possible, but the most important are people, not workplaces. I understand the regional context, but we approach it calmly and we plan some solutions. However, we must remember that in recent years Rafako has had difficulties with the implementation of contracts and this is not a company under the supervision of maps – said Minister Jaworowski during a meeting with journalists.

No agreement

The Minister of State Asset does not have instruments enabling direct support of entities finding a difficult financial situation, which is why he asked the ARP and PFR to present the possibility of possible support Rafako.

However, the talks and proposals presented so far did not allow the agreement to be reached, due to the lack of acceptance from the management board of Rafako, as well as its main shareholders and creditors.

Currently, the Industrial Development Agency is conducting a dialogue with a trustee to restore the long -term and constant ability to compete on the market. As part of multi -level activities, ARP participates in talks with a potential investor in the matter of taking over the company and creating an effective financing model.

In the opinion of the Ministry of State Asset, the main challenge, as part of possible activities, remains to secure the portfolio of orders in the short and medium -term perspective, which would be the foundation for recovering the long -term Rafako operating stability.

Government help for Rafako

In 2021, Rafako was in a difficult situation and ARP provided her public aid in the amount of PLN 100 million. In mid -2024, to provide support in developing a possible agreement, ARP joined some conversations between Rafako and creditors. In the assessment of the maps, further involvement in Rafako affairs must be carefully considered due to the impact of regulations arising from European competition law.

Rafako bankruptcy

The District Court in Gliwice issued a decision on the bankruptcy of Rafako on December 19 last year (it became final on January 21). A trustee was appointed then, which was Wojciech Zymek. January 23 this year The trustee informed about the conduct until February 28 this year. group layoffs to cover up to 699 employees of the company.

The Management Board of Rafako filed for bankruptcy on September 26, 2024, indicating the inability to agree with the key creditors of detailed conversions of the Company's obligations to shares in an increased share capital or an alternative scenario for further restructuring of the company's obligations that would reduce debt. According to Rafako, it could allow the company to regain the ability to obtain external financing for future orders.

Appeal for additional help

Trade unionists from Rafako, President of Racibórz and staroste Raciborski signed the open letter to the Prime Minister Donald Tusk for accelerating procedures to aim to save the bankruptcy of the plant.

“Dear Prime Minister, we are asking you to intervene, because we see that without her Rafako will cease to exist. (…) We are grateful that finally the interviews of the Industry Development Agency with the trustee announced by the Ministry of State Asset.
