Rafako withdraws from its intention to file for bankruptcy, it was announced on Thursday. The company was the contractor of a power unit with a capacity of 910 megawatts (MW) in Jaworzno. Earlier, we reported that Rafako and Tauron Wytwarzanie concluded an agreement under mediation.

The Management Board of Rafako informed on Thursday that “on February 9, 2023, it decided to withdraw from the intention to file for bankruptcy”. As explained, “there have been a number of events”, which, in the current assessment of the Management Board and relevant organizational units, give grounds for stating a significant, positive change in the situation and its environment, and as a consequence, the insolvency assessment has become outdated.

Rafako on January 12 this year. informed that it intends to file for bankruptcy in connection with a call received from Tauron Wytwarzanie for payment of PLN 1.31 billion in contractual penalties and damages in connection with defects in the unit in Jaworzno.

Rafako and Tauron Wytwarzanie concluded agreements under mediation on Tuesday. They plan to finalize the terms of the settlement by February 28 and sign it by March 8, 2023.
