The 51 -year -old was responsible for causing an accident on the road Rafałówka – Protasy, in which the passenger riding with him – his good friend. The driver was drunk, he was sentenced to 6.5 years in prison.
The court also ruled a lifetime ban on driving and awarded 30,000. PLN compensation for the daughter of the deceased, 10 thousand PLN for a man who in this case was wounded and five thousand zlotys for a social purpose.

The verdict is not final. The prosecutor's office wanted seven and a half years in prison, defense – as mild as possible (the lowest, with this legal qualification, is five years in prison).
He had over three alcohol per mille in his blood
The accident occurred in September last year on the road Rafałówka – Protasy near Bialystok. The prosecutor's office accused the accused that he deliberately violated – while driving a car being in a state of intoxication – the rules of safety in land traffic, he did not exercise due caution, lost control of the vehicle at the bend, pulled off the road, and the car rolled over. One of the passengers died on the spot, the other went to the hospital.
It turned out that the driver had over three alcohol per mille in his blood.
Initially, he said that he did not lead
In the investigation, the 51-year-old only confessed to driving into intoxication, but not to cause an accident. In the first explanations he spoke about the person who was driving a car at the time, he was to be only a passenger sitting in the back. According to this version, although he started and his intention was to go to Bialystok, but after a short section he was to say that “he couldn't go”. The driver was to be a random boy, the 51-year-old even described what he looked like.
However, the man pleaded to both allegations, that is also the fact that he was the driver. He expressed repentance, apologized to his loved ones and assured that he would like to compensate for them financially.
According to an expert, he drove even about 125 km/h
Justifying the judgment, Judge Justyna Gosiewska emphasized several times how irresponsible the accused behaved, getting behind the wheel in this state of intoxication and how dangerously he drove the car. The expert's opinion evoked, but also the testimonies of witnesses, according to which the car drove very quickly (according to an expert, even about 125 km/h).
The judge pointed out that the accused changed his explanations; Initially, he said that the driver was someone else and did it at the scene of the accident so reliably that the police using a dog were looking for a person who, according to the accused – after the accident, was to escape from there.
“Getting into this state of intoxication in this state of intoxication was completely deprived of any critical brakes about his condition,” said judge Gosiewska.
Court on “ease of making very irresponsible decisions”
Referring to the punishment, among the circumstances soothing the court mentioned repentance, although he did not rule out that it was an attitude for the use of the trial and described it as a “spreadside repentance”, and above all the criminal record. But at the same time, the judge reminded how the accused rode that he had no resistance to get behind the wheel and had “ease of making very irresponsible decisions.”
“He was completely deprived of any criticism about his reprehensible behavior,” she emphasized. She also said that the penalty of 6.5 years in prison is a “adequate, commensurate to the degree of culpretation and social reception”.
Driver's defender Mateusz Olchanowski told reporters that he would submit a request for justification of the judgment in writing, which opens the way to a possible appeal. He added that he was especially about the amount of punishment.
