Sejm Marshal Elżbieta Witek, making the decision to reassume the vote on August 11, referred to five legal opinions. They are all from 2018. Professor Andrzej Zoll, the former president of the Constitutional Tribunal, said in TVN24’s “Fakty po Faktach” that the speaker “lied to the deputies” and that her behavior was “a denial of parliamentary democracy”. – Marshal Witek, if she is a person of honor, should already step down – he added.
Last Wednesday, during the session of the Sejm, which adopted, inter alia, the anti-TVN law, there was a controversial reassumption of the vote on the motion to adjourn the session. First, the Sejm accepted this motion, but after the break extended several times, the Sejm Marshal Elżbieta Witek from Law and Justice ordered a reassumption of the vote, which was supported by 229 deputies, with one vote against and one abstention. In another vote, the Sejm rejected the motion to adjourn the session.
Marshal Witek, explaining then her decision on the reassumption, said that during the break she “consulted five lawyers” on the subject.

Professor Zoll: If Marshal Witek has the honor, she should step down
Professor Andrzej Zoll, former president of the Constitutional Tribunal and former Ombudsman, spoke more about this case in TVN24’s “Fakty po Faktach”.
– It turned out that the marshal had deceived the Members by talking about the opinions of five legal experts. This is already a scandal. This is a scandal when it comes to the attitude of the Speaker of the Sejm, the second person in the state, it should not happen, it compromises our parliamentarism – he said.
As the former president of the Constitutional Tribunal continued, the marshal’s behavior “is a breach of the basic principles of the functioning of parliamentarism”. – I think that Marshal Witek, if she is a person of honor, should already step down, not by voting in the Sejm, but on her own initiative, she should resign from this position – he said.
Professor Zoll: This is the denial of parliamentary democracy
When asked if we are still dealing with a parliamentary democracy in Poland, he replied: – we do not, it is a denial of parliamentary democracy.
– Actually, the lawyer has nothing to say here. All the rules of a civilized society were broken in this case – he continued.
Professor Zoll pointed out that “this is what the Sejm is for, to pass laws, to indicate where the majority is, but it must be a fair game”. – And here it is simply the side that has lost, disgracefully canceling its defeat. This defeat will last, the ruling party will not explain it, it will go down in the history of parliamentarism, but the worst element in the history of parliamentarism, he said.
