Reassumption of voting in the Sejm. The Sejm Analysis Office is responsible for the case of Elżbieta Witek

The Sejm Analysis Bureau said that on August 11, he did not receive an order from the Speaker of the Sejm, Elżbieta Witek, regarding the legal analysis of the reassumption of voting. It has been added that “oral consultations are not subject to registration”. It was an answer to a question from MP Tomasz Zimoch. Earlier, Witek said that that day “an oral interview and consultation” took place in her office.

On August 11, during the session of the Sejm, at which, inter alia, lex TVN was adopted, there was controversial reassumption of the vote concerning the motion to adjourn the meeting. First, the Sejm accepted this motion, but after the break extended several times, the Sejm Marshal Elżbieta Witek from Law and Justice ordered a reassumption of the vote, which was supported by 229 deputies, with one vote against and one abstention. In another vote, the Sejm rejected the motion to adjourn the session.


Marshal Witek, explaining then his decision on the reassumption, said that it was during the break “consulted five lawyers” on this topic. A few days later, the Sejm Information Center published the opinions that Marshal Witek was to “consult”. All five opinions are dated April 2018. The marshal herself showed them during an interview on government television.

On Friday, the Sejm Analysis Bureau answered the question about the circumstances of the reassumption order. It was directed by Tomasz Zimoch, member of the Polish 2050 parliamentary circle.

The deputy asked “whether on August 11, during the ordered break in the session of the Sejm, the Marshal of the Sejm contacted the Sejm Analysis Bureau”, and “whether during this break the Sejm Analysis Bureau was asked for an opinion” and, if so, what it was about.

BAS replied that Elżbieta Witek did not commission such an opinion.

“On August 11, 2021, the Sejm Analysis Bureau did not receive an order from the Marshal of the Sejm, including one whose subject would be a legal analysis of regulations relating to the institution of reassumption of voting” – we read. “At the same time, it should be pointed out that oral consultations are not subject to registration” – added the Sejm Analysis Bureau.

Witek: There was an interview and oral consultation

Just about Witek spoke at the oral consultation during the press conference on Wednesdayj, when she once again explained her actions during the meeting on August 11.

Speaking about which lawyers were to advise her during the break, she said: – They were officials, employees of the Sejm Analysis Bureau, as well as the office of the Speaker of the Sejm. I do not believe that I should publicly disclose the names of non-public officials.

– On that day, within half an hour, BAS did not make a written opinion. These opinions were created later, they are on the internet. That day there was an oral conversation and consultation – said Witek.

She also said that the opinions she quoted on government television and published by the CIS “were additionally” so that she could read them. – I made the decision sovereignly, after reading the opinions of my lawyers here in the Sejm, as well as after reading the written ones that were prepared for the reassumption of the vote. She has not changed, the regulations have not changed – said the marshal.
