The resolution on the National Council of the Judiciary states the obvious. Nothing more than stating the facts – said senator Krzysztof Kwiatkowski on TVN24. Senator Wadim Tyszkiewicz assessed that President Andrzej Duda – in a letter sent to the Speaker of the Sejm – “is once again on the wrong side of power and is giving himself testimony.”

There is a parliamentary draft resolution in the Sejm on “removing the effects of the constitutional crisis in the context of the political position and functions of the National Council of the Judiciary in a democratic state ruled by law.” The project states that three resolutions of the Sejm of 2018, 2021 and 2022 regarding choice judges – members of the National Council of the Judiciary were undertaken in gross violation of the constitution and calls on members of the National Council of the Judiciary elected contrary to the constitution to cease their activities in the Council.

President Andrzej Duda wrote a letter to the Speaker of the Sejm, Szymon Hołownia, regarding this resolution. He declared that he would “never consent to undermining the status of judges appointed by the President of the Republic of Poland.”

Two independent senators – Krzysztof Kwiatkowski and Wadim Tyszkiewicz – talked about the draft resolution and the president’s letter in “Fakty po Faktach” on TVN24.

Kwiatkowski said that “the president is contradicting himself a bit.” – There are three points in the resolution. Each concerns the defects of the so-called judicial representation in the National Council of the Judiciary. She is a judge only in name, because it is difficult to talk about representation from the judicial community if politicians choose these judges, he said.

– This resolution states the obvious. We already have judgments of the Court of Justice of the European Union, the European Court of Human Rights, and the combined chambers of the Supreme Court. They all say the same thing – that we have a systemic defect in the appointment of the National Council of the Judiciary in the part relating to judges. Nothing more is included in this resolution than the statement of facts that are contained in many decisions of both Polish courts and European tribunals – said Senator Kwiatkowski.

Tyszkiewicz: the president is on the wrong side of power

Wadim Tyszkiewicz said that “one thing is certain.” – The judicial system has been destroyed, taken over by one party and it needs to be straightened out, it needs to be fixed – he said.

– If Mr. President is on the wrong side of power again, he will bear witness to himself. This needs to be fixed. Poles expect this. The judicial system as it exists today is unacceptable. We will do everything in our power to fix this system, he declared.
