The first reading of the government’s amendment to the Road Traffic Law is scheduled for the first reading in the Sejm on Friday. The new regulations are to change the penalty point system, make the amount of the third party liability insurance premium dependent on the number of penalty points and increase the amount of fines and fines for traffic violations.

According to the schedule of the ongoing session of the Sejm, on Friday, October 1, at approx. At 15.30, the first reading of the government’s bill amending the Road Traffic Act and certain other acts is scheduled. This clause includes 5-minute statements on behalf of the clubs and 3-minute statements on behalf of the circles.

The Council of Ministers adopted the bill at the end of July. The bodies responsible for its development were the ministries of: infrastructure, interior and administration, and justice.

The planned date of entry into force of the new regulations is December 1, 2021.

Mandates 2021 – new tariff

The draft provides for an amendment to the Code of Petty Offenses, providing for an increase in the maximum amount of the fine from PLN 5,000 in the event of traffic offenses. PLN up to 30 thousand. zloty. The amount of the fine that can be imposed in the ticket proceedings is to be increased – up to PLN 5,000. PLN, and in the case of multiple offenses – up to 6,000. zloty. If the driver pays the fine during the inspection, then its amount will be reduced by 10 percent.

Exceeding the speed limit by more than 30 km / h is to result in a minimum fine of 1.5 thousand. PLN, regardless of whether the infringement was found in a built-up area or outside this area. If the perpetrator commits such an offense again within 2 years, he will be fined no less than PLN 3,000. zloty.

MANDATES, TPL FEE AND PENALTY POINTS – WHAT SHOULD CHANGE? >>>

The minimum fine for misconduct towards a pedestrian is to be no less than 1.5 thousand. zloty. This includes, for example, overtaking at a pedestrian crossing, avoiding a vehicle that has stopped to give way to a pedestrian. If the perpetrator commits such an infringement again within 2 years, the fine will not be less than PLN 3,000. PLN, and in the event of a real threat to the life and health of pedestrians, the court may additionally order a driving ban.

If the draft law enters into force, driving a motor vehicle after the use of alcohol or a similar measure will be subject to arrest or a fine not lower than PLN 2.5 thousand.

Driving a vehicle without the required authorization will result in a penalty of arrest, restriction of liberty or a fine of PLN 1,000. zloty. If the perpetrator of the above-mentioned offenses, he commits such an offense again within 2 years, the fine will be no less than PLN 2,000. zloty.

Penalty points

A mechanism is to be introduced which will make the removal of penalty points for violation of road traffic regulations conditional on the settlement of the fine.

In addition, points are only canceled after 2 years from the date of payment of the fine. According to the Ministry of Infrastructure, this should ensure a quick and effective enforcement of the sentence

After the changes for violating traffic regulations, the driver will be able to get up to 15 penalty points, currently the maximum number of points for some offenses is 10.

The penalty point limit will not change.

Third party liability insurance – changes

As part of the regulations, lower liability rates for safe drivers are to be introduced.

The draft act is to make it possible to provide insurance entities with data from CEPiK and to adjust the rates of motor insurance to the history of the driver’s offenses and the penalty points received by him.
