Krystian K., 49, was charged with failing to help a man who had been hit by a car. After midnight on New Year's Day, he drove his Nissan into a 25-year-old man standing on the road in Rumia (Pomeranian Voivodeship). The pedestrian died on the spot.
Mariusz DuszyĆski, spokesman for the District Prosecutor's Office in GdaĆsk, said on Friday that 49-year-old Krystian K. was charged with failing to provide assistance to a victim in a road accident in Rumia.
“The man admitted to the charge and provided explanations, but we are not disclosing their content,” added prosecutor DuszyĆski.
As a result of the accident, a 25-year-old man who was staying at ul. Sobieskiego in a place prohibited for pedestrians, he died on the spot.
Expert: the driver had no chance to avoid the pedestrian
As PAP found out, a road traffic expert appointed by the prosecutor's office ruled that the driver had no way of avoiding hitting the injured person who was on the road. The accident was influenced by the behavior of a pedestrian who was dressed in dark clothes and was probably bending down on the road in a place not intended for pedestrians.
The investigation shows that the driver had no chance to make an effective defensive maneuver and avoid hitting the man. Initially, the expert concluded that the driver slightly exceeded the speed limit.
The driver was charged
Due to the expert opinion and the findings of the investigation, the driver was not charged with causing a fatal accident. According to preliminary findings of the investigation, after hitting the 25-year-old, the driver stopped and then drove away from the scene of the accident without helping the hit pedestrian.
The accident occurred on New Year's Day after midnight in Rumia on ul. Sobieski. The man who was hit died.
“Despite the rescue efforts undertaken, the 25-year-old man failed to restore his vital functions. The perpetrator of this incident fled the scene of the accident without helping the man,” the police reported after the accident.
On New Year's afternoon, the police detained 49-year-old Krystian K.
Initial findings after the autopsy show that the 25-year-old died as a result of injuries after the accident.
