Attorney Ryszard Kalisz, currently a member of the National Electoral Commission, and in the past, among others, the Minister of Internal Affairs and a long-time SLD politician, will defend Michał Dworczyk – PiS MEP, former head of the Prime Minister's Chancellery – reported “Fakt”. The prosecutor's office requested that Dworczyk's immunity be lifted; the charges concern the email scandal.
The information was confirmed by Kalisz himself in an interview with “Fakt”. – Yes, I will represent Mr. Dworczyk. I am an attorney and defender of the law. Political views do not play any role – he emphasized.
He added that “nothing is happening in this case at the moment, except the request of the Polish prosecutor's office to the President of the European Parliament” to waive his immunity.
– The entire prosecutor's motion has not been published so far, only a statement. To my knowledge, it is imprecise. I also have the qualifications of a European lawyer, so I can represent Dworczyk before the JURI committee meeting in the European Parliament – Kalisz noted.
He argued that his work as an attorney “in no way affects his duties at the National Electoral Commission”, of which he became a member this year.

Motion to lift Dworczyk's immunity and prosecutor's findings
The National Prosecutor's Office explained that “evidence has been collected that sufficiently justifies the suspicion that Michał Dworczyk committed a crime failure to fulfil the obligations imposed on him as a public official, i.e. Secretary of State in the Ministry of National Defence, and then Secretary of State and Minister – member of the Council of Ministers duties“, but also “crimes obstructing criminal proceedings“.
PK emphasizes that “the failure to fulfill obligations was supposed to result from the use of an uncertified and unsecured private email box for correspondence within the scope of the performance of official tasks resulting from the functions performed, which are important for public security and the proper functioning of state bodies.”
“Obstructing the proceedings” was supposed to consist of “helping the perpetrator of a hacker attack avoid criminal liability by instructing an identified person, after reporting the event to the Internal Security Agency, to permanently delete from the private email box, among other things, incoming phishing emails, metadata related to opening phishing emails and links or files contained therein.”
“The result of such action was the destruction of data constituting important evidence for determining the circumstances and perpetrator of the crime,” we read.
