Sejm. KPO. Government information regarding the possible crime of “official omission”

The agenda of the Sejm for next week included an item regarding the government’s information on the possibility of committing the crime of official omission by the previous Prime Minister and the Minister for European Affairs. This omission was to lead to “Poland’s irreversible loss of the advance payment from the National Reconstruction Plan.”

The next session of the Sejm will take place from March 6 to 8. There is no schedule published on the parliamentary website yet, but the preliminary work plan was received by TVN24 reporter Agata Adamek.

According to this plan, on Friday, March 8, in the morning, an item regarding the actions of the previous government regarding the KPO will be considered.

“Information by the government regarding the possibility of committing a crime under Article 231 of the Penal Code by the Prime Minister and the Minister Responsible for European Affairs, consisting in an official’s omission, which led to Poland’s irretrievable loss of an advance payment from the National Reconstruction Plan in the amount of EUR 4.7 billion” – this is the planned point.

§ 1. A public official who, exceeding his or her powers or failing to fulfill his or her duties, acts to the detriment of the public or private interest shall be subject to the penalty of imprisonment for up to 3 years. § 2. If the perpetrator commits the act specified in § 1 in order to obtain a financial gain or personal, shall be subject to the penalty of imprisonment from one year to 10 years. § 3. If the perpetrator of the act specified in § 1 acts unintentionally and causes significant damage, he or she shall be subject to a fine, restriction of liberty or imprisonment for up to 2 years. § 4. The provisions of § 2 shall not apply. if the act meets the criteria of a prohibited act specified in Art. 228.

Money from KPO

European Commission spokeswoman Veerle Nuyts confirmed on Thursday that the Commission had issued a preliminary positive assessment of Poland’s first application for payments from the Reconstruction Fund. Thus, EUR 6.3 billion will go to Poland from the National Reconstruction Plan.

The Vistula River is to receive EUR 59.8 billion (approximately PLN 268 billion) from the National Reconstruction Plan (KPO) and EUR 76 billion (approximately PLN 340 billion) under the cohesion policy for 2021-2027.

The KPO for Poland provides for 56 investments and 55 reforms aimed at strengthening the Polish economy after the pandemic COVID-19.
