Today, larger stores and shopping malls will be open. January 29, 2023 is the first of seven Sundays this year without a trade ban. You will have to wait until April 2 for the next trading Sunday.

In 2023 – as in 2022 – there are seven trading Sundays. The trade ban does not apply on the last Sundays of January, April, June and August, as well as on the Sunday before Easter and on two consecutive Sundays preceding Christmas (maximum until 2.00 p.m. on Christmas Eve).

This means that on Sunday, January 29, 2023, the shops will be open. Once again, on Sunday, shops will be open on April 2, i.e. a week before Easter.

The act gradually introducing a ban on Sunday trading entered into force on March 1, 2018. The regulations provide for a catalog of 32 exemptions. The ban does not apply to, among others: in post offices, pastry shops, ice cream shops, petrol stations, florists, newspaper shops and coffee shops.

Pursuant to the regulations, the ban also does not apply to commercial establishments where trade is conducted personally by an entrepreneur who is a natural person who works in his own name and on his own account.

For breaking the trade ban on Sundays, the penalty is from PLN 1,000 to PLN 100,000. PLN penalty, and in the case of persistent violation of the provisions – the penalty of restriction of liberty.

Since the beginning of February last year, changes in the ban on Sunday trading have been in force, the purpose of which is to tighten the regulations in force so far. After the entry into force of the amendment, the opening of shops on non-commercial Sundays, which also provide postal services, is possible if the revenues from this activity exceed 40 percent of the total. revenue of the institution. Pursuant to the regulation of the Ministry of Finance, sales records are to be kept separately for each retail outlet, even if a given entrepreneur has several such outlets.
