SMS from Biedronka. The chain awards customers a voucher worth PLN 150

According to the Office of Competition and Consumer Protection, some customers of the Biedronka store chain were misled during a promotional campaign. The Office of Competition and Consumer Protection (UOKiK) obliged the network owner to provide them with financial resources. Customers are already receiving text messages informing them that they have been granted a voucher of PLN 150.

President UOKiK issued a decision this week questioning the practices of Jeronimo Martins Polska, the owner of the Biedronka chain, related to the promotional campaign “Magic of Discounts – Toys and Books – Voucher from December 1, 2022 to December 3, 2022.”

Misleading customers

One of them was misleading information about promotion conditions in advertising messages. The information appearing on posters in stores did not provide information about products that could not be purchased with a voucher – informed the Office of Competition and Consumer Protection.

The office explained that as part of the promotion, holders of the Moja Biedronka application or card were encouraged by the network to purchase three products from the books and/or toys category, and they were to receive half of the amount spent on these products in the form of a voucher printed on the receipt. The voucher could be used for further purchases. However, the advertisements in stores lacked a precise list of products that could be purchased. Marketing materials were marked with an asterisk, with smaller print informing about the limitations of the promotion, which was to apply only to selected industrial products or textiles.

“The complaints received by the Office showed that consumers were surprised that they could not pay with a voucher for a significant part of products commonly assigned to these categories,” the Office of Competition and Consumer Protection said. He also pointed out that information about some items not included in the promotion, such as household chemicals, cosmetics, cleaning products or air fresheners, was presented to customers only after purchase – by printing the receipt with the voucher.

“The promotion regulations were not available in the store in such a way that customers could easily read their content before taking advantage of the promotion,” the office pointed out.

The President of the Office of Competition and Consumer Protection, Tomasz Chróstny, issued a decision in which he obliged Jeronimo Martins Polska to provide financial resources to customers who did not use the voucher.

The press office of the Biedronka chain informed the business editorial office of tvn24.pl that Jeronimo Martins Polska is implementing the decision of the President of the Office of Competition and Consumer Protection. “Therefore, as part of the company's consents to be contacted for marketing purposes, customers received information via SMS that they had been granted a voucher in the amount of PLN 150,” we read in the statement.

The press office added that details about the decision were also posted on the chain's website, in the application, in the store, on the notice board and on the official Facebook profile.
