On Wednesday, the District Court in Sosnowiec sentenced Tomasz M. to life imprisonment for the abduction and murder of 11-year-old Sebastian from Katowice. The boy was supposed to be home at 7 pm. He asked his mother on the phone that he wanted to stay at the playground half an hour longer. She never saw him again. The boy’s body was found in neighboring Sosnowiec. M. was also charged with other children. According to the prosecutor’s office, these cases were never reported and were revealed during the investigation.

The District Court in Sosnowiec announced its verdict on Wednesday morning in the case of the abduction and murder of 11-year-old Sebastian from Katowice. Tomasz M. was responsible for committing this crime, whom the prosecutor’s office also accused sexual offenses against other children.

The crime happened in May 2021. Sebastian was kidnapped from a playground in Katowice, transported to Sosnowiec and murdered there. The indictment in this case was filed by the District Prosecutor’s Office in Sosnowiec to the court in June 2022.

M.’s trial ended in early February. It was held in secret due to the nature of the case and the welfare of the victims.

Tomasz M. was responsible for seven crimes. He heard not only allegations related to the murder of Sebastian, even before this crime he was supposed to have sexually abused two other children.

Experts: The man was sane at the time of Sebastian’s murder

Shortly before the indictment was filed, the prosecutor’s office received an expert opinion drawn up after several weeks of psychiatric observation of M. The specialists concluded that the man was sane at the time of Sebastian’s murder and other alleged crimes, so he could be criminally responsible for his actions. He has been in custody since his arrest. In addition to the forensic-psychiatric opinion, the prosecutor’s office also received e.g. opinion prepared by expert sexologists, does not disclose its content.

The charges concerned Sebastian and two other children

Two of the seven alleged crimes against M. concern Sebastian – one of them is homicide with particular cruelty, the second charge is not disclosed by the prosecutor’s office, explaining it by good conduct. The third allegation concerns a sexual offense to the detriment of another child – this crime was reported by the prosecutor’s office in September 2021.

At the beginning of 2022, the prosecutor’s office announced the announcement of four more charges against the suspect. They concern two pedophile acts to the detriment of another minor under the age of 15. The last two are related to the opinion of an expert in the field of computer forensics. During the examination of the secured computer disks, the expert revealed child pornography in the form of over 200 photos and illegal computer software.

During the investigation, the suspect was interrogated several times. According to the prosecutor’s office, each time he confessed to committing the alleged acts, he made extensive explanations. After Sebastian’s murder also took part in a trial experiment, describing the course of the crime. The prosecutor’s office points out that crimes to the detriment of two other children have never been reported to law enforcement – the allegations were based on evidence obtained during the investigation.

He went to the playground, he was supposed to be back at 7 pm

Sebastian was missing on May 22, 2021 – he went to the playground in Dąbrówka Mała in Katowice, he was supposed to return home at 7 pm, but he sent his mother a text message asking for permission to extend the fun for half an hour. Mom agreed, but Sebastian did not return home and did not make contact with his relatives, then the case was reported to the police.

The culprit was identified the next day, based on the analysis of the recordings of surveillance cameras that recorded a passenger Ford near the playground. Several minutes after selecting the registration number of the vehicle, the police reached its owner. It turned out to be a 41-year-old resident of Sosnowiec. The man was detained, and in an interview with investigators he confessed to abducting and then murdering the boy. He showed the investigators where the body was hidden.

The child was strangled, the body was hidden at the construction site

The child’s body was hidden at a construction site in the Niwka district in Sosnowiec – a few kilometers from Dąbrówka Mała, where Sebastian lived. Investigators established that Sebastian was transported to Sosnowiec by car. After his abduction, he was held in several different places. In one of them he was murdered and then transported to a construction site.

Based on the results of the autopsy and additional tests, Sebastian’s cause of death was determined to be asphyxiation. The sexual background of the crime was taken into account in the proceedings from the beginning. The prosecutor’s office declined to comment on this.

He had already been tried for child abduction, and was given a suspended sentence

According to unofficial information, Tomasz M. is an optician in Sosnowiec, after a divorce, he has two children. He was already known to the police. He is threatened with imprisonment for a term of not less than 12 years, 25 years of imprisonment or life imprisonment.

In 2008, in Siemianowice Śląskie, M. kidnapped another child, ordered him to undress and took pictures, then released him. He appeared before a local court on charges of abduction, possession and dissemination of pornographic content involving a minor, as well as receiving computer programs. He did not question his guilt and voluntarily submitted to punishment. In April 2009, the court issued a sentence against him without trial – two years in prison suspended for a five-year probation period. According to police sources, apart from that case, in connection with the abuse of his wife since 2018. M. was forbidden to approach his family.
