Sosnowiec. The beginning of the trial regarding the death of 42-year-old Monika W.-S. Mariusz P., a woman’s former partner accused of murder, and his friend Paweł B.

The trial of Mariusz P., accused of murdering his former partner Monika, has started before the District Court in Sosnowiec (Silesian Voivodeship). His friend, Paweł B, is also accused of committing the crime that took place in July 2021. A third man, who allegedly obstructed the investigation, also sat on the dock. The trial was partially closed by the court.

We informed about this tragedy many times on tvn24.pl, also after the police the body of 42-year-old Monika was found. The trial into her death began on Tuesday, February 7. Earlier, an organizational meeting was held in front of the District Court in Sosnowiec, during which the court decided, inter alia, to partially exclude the openness of the case.

As the spokesman for the Sosnowiec court, Grzegorz Gałczyński, explained, the decision was made in connection with the allegation of rape. The audience is to be asked to leave the courtroom when evidence is being heard in a case of rape, which, however, is not related to the woman’s death. It is about another former partner of Mariusz P., accused of murder.

– It will be quite complicated in terms of organizational issues, because the presiding judge will have to conduct the main case in such a way as to comply with this exclusion – said Judge Gałczyński before the start of the trial.

Body found after four months of searching

A 42-year-old resident of Jaworznik (Żarki commune) went missing in July 2021, shortly after her car was found in a pond in Zawiercie. The car had no license plates and had parts of the body painted over. The woman’s body was found only in November 2021 in Poręba near Zawiercie, it was buried in a five-meter pit.

Prosecutors established that on July 9, 2021, 42-year-old Monika drove a Ford Fiesta accompanied by Mariusz P. from his home in Jaworznik. After breaking up with a man, she wanted to return to her family home. She was last seen at a gas station in Zawiercie, where P. sat in the driver’s seat and continued driving her car from there. The woman was reported missing by her family.

The sunken car belonging to Monika was found on July 14. The trunk lid protruding above the water level was noticed by the angler. The car had no license plates and had traces of scuffing of the identification markings. The uniforms checked the area and the scuba divers inspected the pond. The woman’s body has not been found.

Diary entries

According to the prosecutor’s office, Monika and Mariusz have been partners for about three years. There were misunderstandings and fights between them. According to the woman’s diary, her partner used violence against her. Just before his death, the woman went to his house to finally end the relationship. Shortly after his disappearance, P. was detained on the order of the prosecutor’s office, but the evidence gathered at that time did not give grounds to charge him. The man was arrested again in October in another drug trafficking case.

The circumstances of the disappearance of the 42-year-old were determined by police officers from the Criminal Department of the Provincial Police Headquarters and the District Prosecutor’s Office in Częstochowa. Based on the analysis of the collected evidence, in particular monitoring records, the investigators determined that Mariusz P.’s friend, Paweł B, may be connected with the disappearance of the woman. This man was arrested at the end of November 2021 on charges of obstructing the investigation. Monika’s body was found on November 25 in the place indicated by him.

A request to dig a pit that has become a grave

According to the investigators, a few days before the murder, on July 4 or 5, Mariusz P. asked Paweł B. to dig a large pit with an excavator on his plot in Poręba. On July 9 – according to the prosecutor’s office – after arriving with his partner at the place, he gave her several blows with a hammer to the head and threw her into a pit. Then he was to instruct Paweł B. to fill the pit with earth and ask him to get rid of her car. On July 10, B. – as reported by the investigators – painted over the tailgate and the VIN number and, together with Łukasz W., sank the vehicle in the tank in Zawiercie, where he also threw the registration plates.

The victim had 11 bludgeoning wounds to the head. Due to the advanced post-mortem changes, the experts were unable to indicate a clear cause of her death. At the same time, they decided that the cause of death could be violent suffocation as a result of blocking the mouth and nose and immobilizing the chest as a result of covering it with earth, which is why B., who was previously suspected of obstructing the investigation, was also charged with murder.

Interrogated by the prosecutor, Mariusz P. said that he unintentionally killed his partner during the struggle. Paweł B. explained that his participation in the case consisted only in digging and filling the pit and hiding the car. Łukasz W., who during the interrogation described the circumstances of sinking the vehicle, also pleaded not guilty to the charge of obstructing the investigation.

Mariusz P. and Paweł B. have already been punished in the past.

Murder is punishable by imprisonment from eight to 15 years, 25 years imprisonment or life imprisonment. The offense of obstruction of criminal proceedings is punishable by imprisonment from three months to five years
