In 2002, newborns were swapped by mistake. The 19-year-old, who was one of the children, is now seeking moral damages. The error was detected accidentally, when in 2017, after a marital conflict, a man who was previously considered the girl’s father performed a paternity test, which gave a negative result.

A 19-year-old resident of the Autonomous Community of La Rioja, in the north of Spain, has applied for non-pecuniary damage due to an error made in 2002 by medics at San Millan Hospital in Logrono, the region’s main city. It resulted in the replacement of newborns.

The medical service of the La Rioja region has confirmed that there has been a mistake. Preliminary findings show that the girls were exchanged when the newborns were placed in incubators.

The error was detected accidentally, when in 2017, after a marital conflict, a man who was previously considered the girl’s father performed a paternity test, which gave a negative result. A similar result was obtained in the case of a woman considered to be the mother of the child.
