In the list of legislative works of the government, the assumptions of the draft law on compensation for entrepreneurs in connection with the introduction of the state of emergency were published. The assumptions include a provision that the amount of compensation will amount to 65 percent of the average monthly income from business in June, July and August.
“The draft act introduces the basis for the payment of compensation to entrepreneurs and farmers providing hotel services (…) and entrepreneurs running a business in the field of gastronomy, who will be the group of service providers most severely affected by restrictions in the areas under the state of emergency” – it was written in the assumptions of the project.

Further we read that “the amount of compensation was set for 30 days at 65% of the applicant’s average monthly income from the services provided or activities conducted in the period including June, July and August 2021”.
It was explained that “if you do not conduct business in any of these months, the value of ‘0’ is used to calculate the above-mentioned amount”. However, if the state of emergency is extended or shortened, then “the amount of compensation will be determined proportionally”.
“The compensation will not constitute income within the meaning of the provisions on personal income tax and the provisions on corporate income tax” – it was noted.
The assumptions also added that “the entity to which the compensation was paid will not be entitled to a claim from the State Treasury for compensation for the compensation of the financial loss in the business resulting from the state of emergency” and “for the lost profits that the applicant could have achieved if the loss had not arisen. “.
Compensation for the state of emergency at a government meeting
As government spokesman Piotr Mueller said on Tuesday, a government meeting will take place on Wednesday, at which ministers will discuss, inter alia, a draft law on compensation for the introduction of a state of emergency in the border zone with Belarus. Earlier, the head of the Ministry of Interior and Administration informed that the government will provide compensation.
A state of emergency has been in force since Thursday in the border zone with Belarus, i.e. in part of the Podlaskie and Lubelskie voivodeships. It covers 183 towns. It was introduced for 30 days under the regulation of Andrzej Duda, issued at the request of the Council of Ministers. Government officials justify the need to introduce a state of emergency with the situation on the border with Belarus, where the Lukashenka regime is waging a “hybrid war” and with the Zapad military exercises.
On Monday evening, the majority of the Sejm did not support the resolution abolishing the state of emergency as unjustified by the situation in the country. According to the constitution, a state of emergency may be introduced when, in situations of particular threats, constitutional measures are insufficient.
