Amendment to the Act on Foreigners

At the end of October, an amendment came into force introducing provisions according to which a foreigner detained immediately after having illegally crossed the external border of the EU will have to leave the territory of Poland by the decision of the commanding officer of the Border Guard post. The decision to leave the Republic of Poland also prohibits entry to Poland and the countries of the Schengen Area for a period from six months to three years.

The amendment also introduced a provision according to which the head of the Office for Foreigners may leave an application for granting international protection unheard, if it was submitted by a detained foreigner immediately after an illegal crossing of the external border of the EU. He cannot do this if the foreigner “came directly from the territory where his life or freedom was threatened with persecution or the risk of serious harm, and presented credible reasons for illegal entry into the territory of the Republic of Poland and submitted an application for international protection immediately after crossing the border” .

State of emergency

A state of emergency has been in force since September 2 in the border zone with Belarus (in 183 towns of the Podlaskie and Lubelskie provinces). It was introduced for 30 days under the ordinance of President Andrzej Duda, issued at the request of the Council of Ministers. On September 30, the Seym agreed to extend the state of emergency for another 60 days.

Journalists related to the state of emergency are not allowed to enter the border zone.

Therefore, they are forced to rely on official information provided by border guards and government officials.
