Judge of the Supreme Court, Małgorzata Bednarek, who was a member of the already liquidated Disciplinary Chamber, will now adjudicate in the Criminal Chamber, the Polish Press Agency reported. Bednarek was the first to decide to continue adjudicating and remain in the Supreme Court after the changes.
It entered into force on Friday amendment to the law on the Supreme Court, pursuant to which, inter alia, the Disciplinary Chamber has ceased its activities, and in its place is established the Chamber of Professional Responsibility. Judges hitherto adjudicating in the Disciplinary Chamber may be transferred to another chamber, proposed by the first president of the Supreme Court, or retired. They have one week to make a decision after receiving the proposal.
The findings of PAP in the Supreme Court show that the vast majority of interested judges have already received such offers. Judge Małgorzata Bednarek was the first to respond on Friday. She decided to accept the proposal of the first President of the Supreme Court, to remain in this court and adjudicate in the Criminal Chamber. This means that Bednarek has been a judge of this chamber since Saturday.
Małgorzata Bednarek was appointed to the Disciplinary Chamber of the Supreme Court in September 2018. Before that, for many years she was a public prosecutor, inter alia, in the National Public Prosecutor’s Office. During the adjudication in the Disciplinary Chamber, among others, she chaired the panel that waived the immunity of Judge Józef Iwulski of the Supreme Court. Judge Bednarek also submitted a legal question to the Constitutional Tribunal on the implementation of interim measures by the Court of Justice of the EU. This judge twice unsuccessfully applied for the position of the president of the Disciplinary Chamber.
The judges for the new chamber will ultimately be chosen by the president
On Friday, five judges were appointed to temporarily adjudicate in the new Chamber of Professional Responsibility and the judge in charge of its work. It will be Wiesław Kozielewicz.
In turn, the draw of judges permanently adjudicating in this chamber – as announced – will take place between 5 and 16 August during the College of the Supreme Court, which will be convened by the president Małgorzata Manowska. From all the Supreme Court judges (with the exception of the first president, presidents of chambers and disciplinary and press spokesmen), 33 candidates will be selected at random and immediately presented to the president. The latter will make the final selection of 11 judges who will adjudicate in the Chamber of Professional Responsibility.
