The Supreme Court dismissed the complaint of the Szymon Hołownia committee regarding the rejection of the financial statements by the National Electoral Commission, informed Maciej Brzózka from the press team of the Supreme Court. Hołownia took third place in last year’s presidential elections.
National Electoral Commission rejected in July the financial report from last year’s presidential election of the Szymon Hołownia committee due to the adoption, in violation of the provisions of the Electoral Code, a total of over PLN 201,000.
The Committee exercised its right to bring an action before the Supreme Court. The Supreme Court took up the matter on Wednesday. As Maciej Brzóska from the press team of the Supreme Court told the Polish Press Agency, “the complaint against the resolution of the National Electoral Commission was dismissed”. – The court was sitting in a seven-person bench – he informed.
The allegations of the Polish Military Contingent
In its resolution, PKW indicated that nearly PLN 33,000 was adopted by the Hołownia committee within the prohibited period. Over 19,000 zlotys were paid between May 11 and June 4, 2020, i.e. after May 10, 2020, on which the Marshal of the Sejm ordered elections, and before June 5, 2020, when the NEC accepted the notification from Hołownia about participation in elections ordered on June 28, 2020. In turn, after the election day, from June 29 to September 25, 2020, the Hołownia committee obtained funds in the amount of over PLN 13 thousand.
Almost 170,000 from unauthorized entities
Over 168,000 zlotys paid to the Hołownia committee came from unauthorized entities. It goes, among others o commercial law companies, foundations, associations, persons for whom the committee was unable to establish that they are Polish citizens residing permanently in Poland, as well as accounts of persons running a business for which the committee was not able to prove that it is an account of a natural person conducting business activity, used by that person both for purposes related to this activity and for the purposes related to the daily functioning of a natural person.
Pursuant to the Election Code, financial representatives of election committees are required to submit election financial reports to the NEC. The PKW may accept the financial statements without any reservations, accept it, indicating irregularities, or reject it.
