Tauron and Rafako signed a settlement agreement regarding the block at Elektrownia Jaworzno

Tauron signed a settlement agreement with Rafako ending the dispute over the power unit in Jaworzno, the energy concern announced on Friday. The settlement, which is the result of mediation before the arbitration court at the General Prosecutor’s Office of the Republic of Poland, sanctions the settlement and termination of the contract.

Rafako was the contractor of a new 910 megawatt Tauron power unit in Jaworzno worth over PLN 6 billion. The companies have been arguing for many months over problems in the operation of the block. In mediations with the participation of the General Prosecutor’s Office in February this year, the parties informed about the conclusion of a preliminary agreement, in recent weeks they postponed the date of signing the settlement.

As reported on Friday in the current report, Tauron will receive PLN 240 million in accordance with the settlement for claims which, according to the concern, are the consequence of improper performance by Rafako of the contract for the construction of the unit in Jaworzno.

Tauron’s settlement with Rafako

Under the settlement, Tauron Wytwarzanie will pay Rafako i.a. PLN 10 million for services including settlements of subcontractors and taking responsibility for claims of subcontractors involved in the construction, and PLN 14 million, among others, for for a non-contractual pool of additional parts, the purchase of a site from the construction office as well as workshop and calculation documentation. Tauron will also settle payments for inventoried and accepted works according to their level of advancement. Their total value, taking into account the sums already paid, was estimated at PLN 18 million. Rafako will release subcontractors from any obligations that make it difficult to start cooperation with Tauron Wytwarzanie. The parties will terminate the contract, expiring contractual obligations, and Tauron will release Rafako from its obligations under technical guarantees. Upon signing the settlement, which was confirmed in the annex to the contract of February this year, Tauron is no longer bound by the restrictions on modernization, renovation, optimization or repair of the unit, provided for in the contract.
