The initiation of an investigation into the abuse of powers by prosecutors in connection with the use of content on the suspect Janusz Palikot's phone and the alleged violation of defense confidentiality was refused – the National Prosecutor's Office announced on Friday. According to one of the former politician's defenders, the device was confiscated by the CBA and handed over to the prosecutor's office along with his correspondence with his lawyer.

“The findings do not indicate a justified suspicion of exceeding the powers of the CBA officers or the prosecutor conducting the investigation. They also do not indicate a justified suspicion of unlawful use of information covered by professional secrecy in court,” said Przemysław Nowak, spokesman for PK.

October 7 this year The National Prosecutor's Office informed that due to media information regarding the possible violation of defense confidentiality during the investigation conducted, among others, against Janusz Palikot an inspection procedure was implemented ex officio.

According to one of Palikot's defenders, attorney Jacek Dubois, the officers CBA after his client was detained, they confiscated his phone, and the correspondence contained therein with him as a lawyer was sent to the prosecutor's office. In this way, in Dubois' opinion, there was a breach of attorney-client privilege and an abuse of powers.

At the beginning of October, the president of the Supreme Bar Council, Przemysław Rosati, wrote to the head of the Ministry of Justice, the prosecutor general Adam Bodnar asked “for an urgent clarification of the situation related to the breach of defense and attorney-client privilege” reported by Palikot's lawyer, attorney Dubois.

Previously, prosecutor Łukasz Kudyk from the Lower Silesian Branch Department of the PK in Wrocław referred to the allegations of violation of defense and attorney-client privilege made by attorney Dubois. He explained that at the time when the suspect's phone was inspected, Mr. Dubois was not Palikot's defense attorney, so there was no legal relationship between them.

– I confirm that the suspect's phone was examined as evidence. However, with whom the talks were held, in fact, at the time for which these talks were held, Mr. Dubois was not the defender of Mr. Janusz Palikot, so they did not have any defense bond – said prosecutor Kudyk.

Charges against Janusz Palikot, Przemysław B. and Zbigniew B.

Janusz Palikot (he consents to the publication of his image and data), Przemysław B. and Zbigniew B. were detained on October 3 by the CBA in Lublin and Biłgoraj. On the same day, they were taken to the department of the National Prosecutor's Office in Wrocław, where they were charged.

Palikot was charged with eight charges, including seven of fraud and one of misappropriating property. His colleagues, Przemysław B. and Zbigniew B., were also charged with fraud. Przemysław B. was also charged with misappropriation of property.

The court of first instance ruled that Palikot would be able to leave custody after paying PLN 1 million bail. The defense and the prosecutor's office appealed against this decision. The District Court in Wrocław decided that Janusz Palikot would remain in custody without the possibility of being released on bail.

Mec. Jacek Dubois previously announced that his client pleaded not guilty to the charges brought against him.
