The Court in Strasbourg blocks the transfer of judges – Marzanna Piekarska-Drążek, Ewa Gregajtys, Ewa Leszczyńska-Furtak

The European Court of Human Rights issued an injunction in the case of criminal judges transferred to the labor and social security department of the Court of Appeal in Warsaw. This security is immediately enforceable. “This is another case of judges repressed for their judgments, in which the ECtHR decided to issue an interim measure,” wrote Piotr Zemła, the judge’s attorney.

The President of the Court of Appeal and the disciplinary prosecutor for judges, Piotr Schab, wanted judges Marzanna Piekarska-Drążek, Ewa Gregajtys and Ewa Leszczyńska-Furtak to be transferred to the labor and social security department of the Court of Appeal in Warsaw.

European Court of Human Rights on Tuesday issued a warrant in their case. It suspends the execution of the transfer decision and prohibits their transfer to another department without their consent. This security is immediately enforceable.

“This is another case of judges repressed for their judgments, in which the ECtHR decided to issue an interim measure,” Piotr Zemła, the representative of the judge in Strasbourg, wrote on Twitter.

In August, the presidents of the court transferred Judge Ewa Gregajtys and Judge Ewa Leszczyńska-Furtak to the labor department. Later, judge Marzanna Piekarska-Drążek was also transferred.

They repealed the judgments of judges appointed by the new National Council of the Judiciary and refused to adjudicate with them. Therefore, the disciplinary prosecutor of judges, Piotr Schab, accused them of “long-term negation of the performance of fundamental official duties”.

In October, the criminal students received orders to present disciplinary charges. Became the first people prosecuted for disciplinary action for “refusing to do justice”, a new disciplinary offense introduced by a law authored by the President Andrzej Duda.
