The disclosed message, which is supposed to come from Michał Dworczyk’s e-mail box, was commented on by Mariusz Muszyński, vice-president of the Constitutional Tribunal. According to its content, the head of the Chancellery of the Prime Minister was to talk to the president of the Constitutional Tribunal, Julia Przyłębska, about the actions of the Tribunal. In a statement posted on his website, Muszyński wrote that “he does not share the President’s view of the role of the Constitutional Tribunal, the manner of proceeding before the Constitutional Tribunal, and the role of the judge in the political and social life of Poland”. He said that “he knows both the matters mentioned in the e-mail, connected with his name”. He added that he can say more about their procedure and “possible influence attempts after being released from professional secrecy by the relevant authorities”.
According to the e-mail published on the Internet, the head of the Chancellery of the Prime Minister Michał Dworczyk was to consult the President of the Constitutional Tribunal, Julia Przyłębska, on the actions of the Tribunal. “Mateusz, today (shortly after your conversation) I visited Mrs. Julia P. I discussed 3 topics with the president” – Dworczyk was supposed to write to the prime minister Mateusz Morawiecki. The “Three Topics” was supposed to concern judgments pending in the Constitutional Tribunal. In two cases, the chairman of the composition was the vice-president of the Constitutional Tribunal, Mariusz Muszyński.

Muszyński: my knowledge and understanding of the Constitution is horrendously different from the knowledge and understanding of this act by the President of the Constitutional Tribunal
On July 6, Muszyński’s private website published a post entitled: “Statement on the so-called Dworczyk’s e-mails”.
“Due to numerous publications concerning alleged e-mails of Minister Dworczyk about his meetings with the President of the Constitutional Tribunal, in which my name appears in the information allegedly obtained from the President of the Constitutional Tribunal, I kindly ask you not to connect me with any arrangements that may have been made at these meetings (if such took place) “- we read in the statement.
“I know both of the cases mentioned in the e-mail, connected with my name. In both cases I was the chairman of the adjudicating panel. I can say more about the procedure in these cases and possible influence tests after being released from professional secrecy by the relevant authorities” – added.

Muszyński: I have never had any dialogue with the Prime Minister by e-mail or by phone
On July 8, another message appeared on Muszyński’s website entitled “New alleged e-mail from Minister Dworczyk”. It was published on the same day that another e-mail was released on the Internet, supposed to come from August 19, 2018.
Michał Dworczyk was then supposed to write to Prime Minister Morawiecki in several cases, including correspondence with the vice president of the Constitutional Tribunal.
“Judge Muszyński called to make sure that his e-mail reached you – he warned (and asked to tell you not to be surprised) that he was sending you letters from Lucius Domitius :)” – the head of the Chancellery of the Prime Minister was supposed to write.
The prime minister was to write back: “Ok. Yes – he came. From a strange address, indeed.”
“In connection with the new e-mail in which my name appeared, I would like to kindly inform you that I spoke to Minister Dworczyk by phone only once regarding the Legislative Council at the request of one of the law professors I know, who asked me for a recommendation. It was about 4 years ago. (2018) The moment of time is easy to locate, because I remember that the minister was then on vacation in Greece. We wanted to ask the vice president of the Constitutional Tribunal about the statements issued. We sent questions to the Constitutional Tribunal as well as to Muszyński’s e-mail address at the Cardinal Stefan Wyszyński University in Warsaw. We are waiting for answer.
“I’ve never been anyone’s man”
According to Onet, the discrepancy between Muszyński and Przyłębska may be due to the fact that Muszyński was a faithful supporter of the minister of justice, the prosecutor general Zbigniew Ziobro and the president of the Constitutional Tribunal was to focus on cooperation with Morawiecki.

Kamila Gasiuk-Pihowicz, a member of the Civic Coalition, commented on the statements of the vice president of the Constitutional Tribunal on Tuesday. “Mariusz Muszyński cuts himself off from Julia P. and suggests that he will say more after being released from official secrecy by the relevant authorities. Muszyński is a judge and, since 2017, vice-president of the Constitutional Tribunal chaired by Julia Przyłębska. He is one of the so-called understudy judges who were appointed to previously filled seats in the Court in 2015.

Correspondence is still published on the Internet, among others from the private mail of the head of the chancellery of Prime Minister Michał Dworczyk and Prime Minister Mateusz Morawiecki. So far, the government has questioned the veracity of the e-mails, but so far have not shown a single example of a false e-mail. There are at least a few messages that have been confirmed as true by the persons named in the correspondence.
