Will the Disciplinary Chamber be liquidated? I would like it very much – admitted Agnieszka Dziemianowicz-Bąk (Left) MP. The guests of “Coffee on the bench” commented on the words of Jarosław Kaczyński, the president of PiS, about the unrecognized chamber of the Supreme Court and respecting the judgment of the Court of Justice of the European Union. Krzysztof Bosak from the Confederation stated that “the government will comply with the rulings of the CJEU because it needs EU money”.
Jarosław Kaczyński was asked in an interview for the Polish Press Agency when one can expect the reform of the unrecognized Disciplinary Chamber of the Supreme Court announced by the government and whether it will implement the judgment of the Court of Justice of the European Union. The PiS president said that “he does not recognize such judgments, because they definitely go beyond the treaties and expand the jurisdiction of EU courts.”
He added that “the reform prepared by Minister Anna Dalkowska provided for the liquidation of the Disciplinary Chamber before the judgment of the CJEU and was discussed and positively assessed by the security committee a few months ago.” – I think that this reform should be undertaken, because it was planned anyway, at most it will be a matter of accelerating it, but it is also part of the Polish Order. We will liquidate the Disciplinary Chamber in the form in which it functions now and thus the subject of the dispute will disappear – Kaczyński announced.
Hetman: Kaczyński will sacrifice the Disciplinary Chamber to get money from the EU
The situation around the unrecognized Disciplinary Chamber of the Supreme Court and Jarosław Kaczyński’s statements were discussed on Sunday by the guests of “Coffee to the bench” on TVN24.
MEP Krzysztof Hetman from PSL assessed that the PiS president is afraid of losing EU money as a consequence of failure to comply with the CJEU judgment. “He knows perfectly well that without the hundreds of billions he has promised, he won’t be able to win the next election,” he said.
– If he does not get this money, he knows that he will not win this election. So he will sacrifice the Disciplinary Chamber as it is at the moment in order to get this money, he explained.

Dziemianowicz-Bąk on the words of Kaczyński: an attempt to ease the conflict with the European Commission
Agnieszka Dziemianowicz-Bąk, MP from the Left, stated that “we do not know yet” whether Kaczyński really wants to make changes in the judiciary. – If he really wanted to, he could do it in one day. A draft of the Left Law is waiting in the Sejm, liquidating the Disciplinary Chamber. He has been waiting there since April – she pointed out.
According to her, the words of the PiS chairman are “an attempt to warm up, ease the conflict with the European Commission”. Will the Disciplinary Chamber really be liquidated? I would like it very much – she said.

Jabłoński: not every reform ended as we wanted it to
Deputy foreign minister Paweł Jabłoński from PiS admitted that “not every reform ended as we wanted it to.”
However, he assessed that “if a disciplinary system is introduced that will be effective, I am unfortunately convinced that we will again have complaints from the judiciary and from the opposition politicians who support these judges, who will say that any system in which judges they bear any real responsibility that is contrary to European law. “

Bosak: the government will comply with the CJEU rulings because it needs EU money
Krzysztof Bosak from the Confederation stated that “the government will comply with the rulings of the CJEU because it needs EU money”.
– Despite this sovereignty tensions of Prime Minister Morawiecki or President Kaczyński, the government is available for the money it negotiated last year – he added.

The vice-president of the Covenant, Magdalena Sroka, said, however, that “the reform of the judiciary certainly did not bring the expectations placed on it and it must be completed.” – Here is also the question of whether the competences of the CJEU do not go too far, or whether they stick to the treaty guidelines – she assessed.

Kierwiński: Even your cadres are starting to notice that PiS is ending
MP Marcin Kierwiński from the Civic Platform, on the other hand, spoke about the position of the first president of SN Małgorzata Manowska in the case of an unrecognized chamber, which, in the opinion of many lawyers, constitutionalists and judges, is not a court within the meaning of the law.
In two ordinances issued on Thursday, Manowska partially froze the work of the Disciplinary Chamber in question. This decision changes the position of the first president of the Supreme Court. Initially, on July 16, Manowska suspended the interim measures ordered by the CJEU, which meant that the judges of the chamber – contrary to the position of the European tribunal – adjudicated in disciplinary cases.
– Even your cadres, Mr. Minister, those people whom you appointed, who often stretched the Polish law, today begin to notice that PiS is ending, that PiS’s power is ending and they are simply afraid of responsibility and start to flee this responsibility Kierwiński said, addressing his words to Jabłoński.
He also asked the deputy minister not to defend the disciplinary reform in the judiciary, which – as he assessed – “everyone has abandoned because they are afraid of responsibility”.
