The Court of Appeal in Warsaw dismissed the Prosecutor General’s motion to suspend the execution of the court’s decision prohibiting the registration of the Independence March as a cyclical assembly. The request in this case was filed by Prosecutor General Zbigniew Ziobro in an extraordinary complaint filed with the Supreme Court on Friday. In this complaint, GUT wants to reverse the court’s decision prohibiting the registration of the Independence March as a cyclical assembly.

When asked about the SA decision, Ziobro said that the decision had “a purely political color and temperature”. As underlined by the underlying arguments that the Independence March is not a cyclical march because it could not take place due to a pandemic, they are full of hypocrisy. – These are (arguments) of a political, not legal nature – emphasized the minister. He pointed out that despite the epidemic restrictions “consent was given to the demonstrations to women’s organizations on the same route, within the same range”, which, in his opinion, is “an open provocation, calculated to cause riots during such a transition”.

According to Ziobro, the court must take into account certain facts that are force majeure. – Every lawyer learns already during his studies that in the field of any legal order, be it civil or criminal law, or a state of higher necessity, or in the field of administrative order, one must take into account circumstances that were objective and independent of the party whose this law applies. It cannot be burdened with the consequences of events, said the head of the Ministry of Justice.

As he assessed, we are dealing with political judgments and decisions which “show that the state of politicization of the Polish judiciary has exceeded a certain measure that can be considered admissible.”

Asked by journalists whether he plans to appear on the march, should it happen, Ziobro pointed to “civil disobedience”. – I once heard, probably even Donald Tusk, about the so-called civil disobedience. I think that the organizers of the march will be able to creatively use such concepts of the Civic Platform of Mr. (Władysław) Frasyniuk or other representatives of the KOD movement to defend their basic civil rights, which are clearly taken away from them for political, non-legal reasons – he replied minister.

In his opinion, Tusk should be asked where his patriotism and sense of responsibility are. – He may not agree with me, he may not even agree with the changes in the judiciary that have taken place. He has the right to do so, but he should never agree to such arguments and reasons that are the basis of decisions made in relation to Poland. Humiliating towards Poland and placing us in the role of some Bantustan, a state under guardianship – said the head of the Ministry of Justice.
