On Friday, the appeal process of Jakub A., accused of the brutal murder of 10-year-old Kristina from Mrowiny, began before the Court of Appeal in Wrocław. In the first instance, the man was sentenced to life imprisonment. During the investigation, he confessed to the crime.

Three appeals were filed with the Court of Appeal in Wrocław. They were submitted by the prosecutor’s office, the attorney of the mother of the murdered 10-year-old girl and the accused with the defender. The latter apply for the case to be discontinued, arguing that Jakub A.’s mental state is the reason. Kristina’s mother’s attorney requests an increase in compensation, and also does not agree with the first-instance court’s reservation regarding the 30 years after which Jakub A. could apply for conditional early release. In the appeal, the prosecutor’s office also indicates the period after which the man could apply for early conditional release, but also appeals against the change in the legal classification of the act. It’s about incitement to murder. Indeed, A. was accused not only of murder, but also of incitement to murder with particular cruelty, due to a motivation that deserved special condemnation. The court of first instance, however, did not take into account the particular cruelty and convicted him of incitement to the usual type of murder.

The court of first instance: treated the victim as an obstacle

The trial before the court of first instance was closed to the public. He moved before the District Court in Świdnica in September 2021. Jakub A. – in October 2022 – for the murder and desecration of the corpse lifer. The court also convicted him of earlier incitement to kill a 10-year-old girl. He can apply for parole after 30 years. He was also deprived of public rights for 10 years. The convicted person – according to the judgment of the court of first instance – is also to pay PLN 100,000 in compensation to his parents and over PLN 97,000 in all costs of the preparatory proceedings and court costs.

Judge Jerzy Zieliński emphasized that the act committed by the man deserves special condemnation. – He acted with the direct intention of depriving the victim of life, with particular cruelty, treating the victim as an obstacle to arranging a personal life with her mother – emphasized the judge.

According to the court, A. inflicted 30 stab wounds on the girl. Then he insulted her corpse.

The decision was not final. The prosecution was initially satisfied with the decision. “This verdict is absolutely justified,” the prosecutor commented. A representative of the mother of the murdered 10-year-old girl was of a similar opinion.

She was coming home from school, never made it home

On June 13, 2019, Kristina finished her lessons around 1 p.m., left school in the center of Mrowiny and headed to her house, about a kilometer away. She was last seen 200 meters from her place of residence. But she never got there.

At first, the family searched for her on their own. Then the authorities were notified. Firefighters checked the surrounding water reservoirs, a police helicopter searched the area from the sky. The 10-year-old was searched by adults, on foot and in cars. The children rode bicycles. There was no trace of Kristina.

A few hours later – in the forest, near the village of Pożarzysko (about three kilometers from Mrowiny) – random people came across the body of the girl they were looking for.

Investigators initially said it was a homicide. After a 12-hour autopsy, they said the child died of stab wounds to the chest and neck.

Initially, the prosecutor’s office also reported that the crime was sexually motivated.

Jakub A. was arrested a few days later

An intensive search for the perpetrator continued for several days. Police appealed for help to residents of nearby towns, as well as drivers who were passing that way and may have seen something suspicious.

At the press conference, the Minister of Justice, the Prosecutor General Zbigniew Ziobro assured that the arrest of the murderer of the 10-year-old is only a matter of time. He emphasized that it was an honorable matter for the Polish prosecutor’s office and the police.

On June 16, 2019, a 22-year-old student, Jakub A., was detained in one of the houses in Wrocław’s Krzyki. The man was charged with homicide with particular cruelty, as well as with inciting a friend to complicity in the murder. He was to offer 10,000 zlotys for help.

The court, at the request of the prosecutor’s office, arrested Jakub A. The man confessed to the alleged acts.

He was trying to confuse investigators. Unsuccessfully

The prosecutor’s office did not disclose the motive for the murder. It is known that the mother of the murdered 10-year-old is the aunt of Jakub A. The man knew the girl and planned the crime down to the smallest detail. The trail of the investigators was to be confused by the fake sexual abuse of Kristina. A. – according to the prosecutor’s office and the police – he wanted suspicions to fall on a pedophile.

– He made efforts to find the culprit of the crime. When he found it too difficult, he searched for all possible material on sexual crimes against children. He was interested in scientific studies as well as media materials. He was so meticulous about building a false lead for us that there was a sexual deviant behind the crime – an informant related to the investigation explained to the tvn24.pl journalist.

According to the investigators, A. left his phone in Wrocław so that on the day of the murder he logged in in the capital of Lower Silesia. He was also supposed to appear in the place where he was recorded by a surveillance camera. He drove to the crime scene in a rental car, bought new clothes, and put on shoes that were not his size. All to divert suspicion from yourself.

Experts: Jakub A. was fully sane

Defender A. Katarzyna Bórawska reported that her client “expresses regret and remorse”. – On behalf of Jakub A., I would like to apologize to the parents of the injured Kristina, her siblings and the whole family. (…) He also asks for no moral evaluation of his actions due to the fact that he attended psychological therapy for over a year. In addition, he was self-medicating with psychotropic drugs, stressed attorney Bórawska.

Prosecutors consulted on the sanity of a student from Wrocław suspected of murdering 10-year-old Kristina. The man was examined by two expert psychiatrists. Later, they applied for two more experts to join the team: a psychologist and a sexologist. In total, they met with the suspect several times.

– The opinion sent to us shows that at the time of committing the alleged acts – incitement to murder and murder – Jakub A. was fully sane. In their opinion, the experts did not find sexual preference disorders in the suspect, Tomasz Orepuk, spokesman for the District Prosecutor’s Office in Świdnica, said in January 2020.

Dozens of expert opinions and an indictment

In May 2021, almost two years after Kristina’s death, an indictment against Jakub A. – On the way back from school, the victim got into A’s car, which was a friend of the family. The accused took her to the forest, where, acting with particular cruelty, he committed the crime of murder, he quoted fragments of the Orepuk magazine. As he added, A. during the trial experiment told in detail about what happened and revealed circumstances “that could only be known by the perpetrator of the murder.”

During the investigation into the death of a 10-year-old girl, several hundred biological traces were examined. – In the course of the investigation, dozens of opinions from various fields were obtained, including 43 genetic opinions regarding the identification of several hundred secured biological traces and opinions of experts in the field of chemistry, dactyloscopy, traseology, psychiatry, psychology and sexology – said the spokesman for the Świdnica prosecutor’s office.
