The National Broadcasting Council will not punish Radio Szczecin and TVP for the case of the son of MP Magdalena Filiks

The National Broadcasting Council decided not to punish Radio Szczecin and TVP Info for disclosing data allowing the identification of the pedophile’s victims. This is about the case of the son of PO MP Magdalena Filiks – the Press website reported.

Magdalena Filiks’s son died on February 17 last year. He committed suicide. It is impossible to make a clear judgment as to the reasons for which the 15-year-old took his own life; the investigation into his death is being conducted by the prosecutor’s office. However, there were opinions – including from the then head of the state commission on pedophilia, Błażej Kmieciak – that the government media at the turn of 2022/2023 led to the identification of the MP’s son as the victim of a convicted pedophile.

The teenager was the victim of a pedophile, Krzysztof F. (in 2018, he ran from the PO list for the West Pomeranian Voivodeship Assembly), who worked as the plenipotentiary of the West Pomeranian Voivodeship Marshal for addictions. Krzysztof F. was convicted in 2021 and sent to prison.

On December 29, 2022, in the morning, Radio Szczecin and TVP Info – both government media – reported that Krzysztof F., a former employee of the West Pomeranian Voivodeship Marshal’s Office, was detained in September 2020 on charges of molesting a 13-year-old boy and giving him and a 16-year-old girl narcotic substances .

So the case was not new. The media did not report on this case earlier because the trial was held in public for the benefit of the injured children. However, when reporting on the trial in December 2022, the editorial offices of Radio Szczecin and TVP Info announced who the harmed children were. Although they did not mention them by name and surname, they described them in such a way that it was easy to connect Krzysztof F. with Magdalena Filiks and her children. She is a KO MP from Szczecin. A narrative emerged that Filiks did not publicize F.’s arrest, trial and conviction so as not to harm her party.

This message, in which the media controlled by the ruling party or supporting it took part, looked coordinated – as Piotr Pacewicz said in OKO.press, “this may indicate orchestrated propaganda activities.” Because other public and right-wing media, right-wing journalists, internet trolls, and Law and Justice politicians immediately got involved.

For two months, we observed in the media and on social media profiles favorable to the then government a campaign of accusations against PO, the main character of which was Filiks. Any voices of opposition and protests against such behavior – i.e. repeated harm to children and public lynching of their family – were met with even more aggressive attacks and accusations of limiting freedom of speech.

Three weeks before the death of his son Filiks, the chairman of the National Broadcasting Council, Maciej Świrski, initiated proceedings to punish Radio Szczecin and TVP Info in connection with “broadcasting content enabling the identification of the victims of a pedophile, which grossly threatened the well-being of minor victims of violence.”

Decision of the National Broadcasting Council

The Press website reported on Friday, January 19 that National Broadcasting Council decided not to punish Radio Szczecin and TVP Info.

Teresa Brykczyńska, spokeswoman for the National Broadcasting Council, informed the Press that the programs broadcast at the end of December 2022 on Radio Szczecin and by TVP Info were subject to “a thorough analysis and detailed assessment in terms of compliance of the broadcasters’ activities with the provisions of media law, taking into account the norms of the Constitution of the Republic of Poland and the Council of Europe Convention on the Protection Human Rights and Fundamental Freedoms.

“During the proceedings, it was established that publicizing the problem of pedophilia among people performing important tasks of state administration was intended to protect a socially justified interest, which is undoubtedly the detection of crimes of this type, their publicity and stigmatization, especially if there were irregularities such as keeping silent on this topic.” – Brykczyńska said.

Press wrote that “according to the National Broadcasting Council, the journalistic materials did not directly disclose the personal data of the pedophile’s victims.” “This information was published on social media and was the subject of Internet users’ inquiries. It should also be mentioned that one of the MPs confirmed the details of the victims in a broadcast broadcast on December 30, 2023 in the morning by TVP Info, i.e. on the day following the broadcast of the broadcasts in question – it was reported .

Since the funeral of the tragically deceased son of MP Filiks, TVP has tried to shift the responsibility for revealing that he was the victim of a pedophile to PO MP Piotr Borys, who was a guest of the station on December 30, 2022. However, a day earlier, information allowing the victim’s identification was provided by Tomasz Duklanowski, then editor-in-chief of Radio Szczecin and author of the original publication on this subject.

“As a result of the proceedings, the broadcasters, i.e. Polskie Radio Szczecin SA and Telewizja Polska SA, were called upon to strictly comply with applicable law, including, among others, a special assessment of those programs in which the social right to information and the press’s obligation to present real phenomena and legal protection of third parties,” said the KRRiT spokeswoman.

As Press writes, the chairman of the National Broadcasting Council, Maciej Świrski, has been delaying the decision on this matter for a long time, among other things, waiting for the results of the prosecutor’s office investigation.

Luft: the chairman of the National Broadcasting Council once again stigmatizes the victims of the tragedy

Krzysztof Luft, former member of the National Broadcasting Council, currently a member of the TVP program council, who also complained about this matter to the National Broadcasting Council, said in an interview with Press that “this response is as unprofessional as it is outrageous.” “Unprofessional, because the proceedings at the National Broadcasting Council were to determine whether there had been a violation of the provisions of the Act or not. And from this inconsistent answer, it is difficult to determine what decision the National Broadcasting Council made in this matter, or even whether it made any formal decision at all. After a year of conducting proceedings,” he added.

“As the first complainant in this case, I have the right to a formal response from the National Broadcasting Council and I will demand it, because despite the passage of a year and several announcements, I have still not received it. This journalism sent by the National Broadcasting Council is outrageous because the chairman of the National Broadcasting Council, instead of impartially assessing the actions of the broadcaster in terms of compliance with the Broadcasting Act, he has apparently succumbed to the broadcaster’s propaganda. He is cynically repeating subsequent lies spread by Radio Szczecin and TVP Info in this matter, once again stigmatizing the victims of this tragedy. This is despicable,” Luft said.
