The National Electoral Commission without a decision on the answer to the letter of the PiS representative

During the Monday meeting of the PKW, she discussed the letter of the Finance PiS Committee of the PiS Committee, which asked the Commission to refer the notification to the prosecutor's office about the crime of failure to fulfill his duties by the Minister of Finance Andrzej Domański.

In a letter addressed to the PKW Law and Justice It indicated that – at least on December 30, 2024, after the decision of the Chamber of Extraordinary Control and Public Affairs of the Supreme Court (which is not recognized – ed.), the party's report from the Parliamentary Elections of 2023 was previously rejected the previously rejected report from the parliamentary elections of 2023 – the Minister of Finance does not carry out this resolution, and PiS did not receive the full amount of funds from the budget.

Member of the PKW Ryszard Kalisz During Monday's meeting, he argued that in the matter of finances for PiS, PKW sent three answers to the Minister of Finance and it makes no sense to return to the case. Referring to the letter of the PiS representative, Kalisz estimated that making the committee “intermediaries is a bad address”. He added that – according to him – the Commission should only formally thank the letter, but not take any steps.

Another member of the committee Maciej Kliś estimated that referring to the PKW a letter requesting the prosecutor's office was “acting on the show”. He added that the attorney has a “free path” and if he thinks that the law has been broken, he can notify the prosecutor's office himself.

According to Ryszard Balicki, the speech by the financial representative of the PiS Committee is “is an attempt to engage in the PKW even deeper into the political dispute.” He was followed by Paweł Gieras, according to which the PiS representative would like to “get his goal with someone else's hands”.

The chairman of the PKW Sylwester Marciniak, taking the floor in the discussion, proposed to vote, who of the members of the Commission is against applying to the prosecutor's office, which he turned to the PKW financial representative of the PiS election committee. Gieras, however, suggested that the PKW leave the letter of the financial representative of the PiS committee without running. Kalisz supported him, according to which the PKW should leave the letter without recognition.

Marciniak pointed out that the PKW answers each letter. In his opinion, also a letter should be given to a letter from the financial representative of the PiS committee, even if the case is left without consideration.

In response, Kalisz again appealed that the PKW “would not get involved in politics” and that he would give a courtesy answer – that he would not recognize the request of the financial representative of the PiS election committee.

The chairman of the PKW proposed that the Commission should return to the case to the letter at the next meeting and that appropriate response projects would be prepared in advance, so that the PKW members could make a decision without subsequent postponement.

Ryszard Kalisz said in an interview with journalists that the request of the financial representative of the PiS election committee is “completely bizarre”.

– It is enough to read Article 304 Paragraph The first of the Penal Code (which says – ed.) That anyone who has any suspicions, justified suspicions can report to the prosecutor's office himself – he said.

– And the fact that this kind of political action was invented so that the PKW was somehow introduced into a political action is not these numbers, gentlemen – Kalisz continued.

National Electoral Commission In August, she rejected the financial statements of the PiS election committee from the parliamentary elections of 2023, showing the evidence of irregularities in spending funds on campaign in the amount of PLN 3.6 million. The result of this decision is to reduce a one -off subsidy for this party, the so -called reimbursement for elections (almost PLN 38 million) by three times the challenged amount, i.e. about PLN 10.8 million, and a reduction in a nearly 26 million annual subsidy from the state budget for party activities by PLN 10.8 million. The consequence is also a refund to the Treasury of the challenged sum, i.e. PLN 3.6 million.

In November, PKW also rejected the annual financial statements of the PiS party for 2023.

PiS appealed to both PKW decisions to the Supreme Court. On December 11, the unrecognized Chamber of Extraordinary Control and Public Affairs of the Supreme Court recognized the PiS complaint regarding the report of the election committee, therefore the PKW adopted this report on December 30. In the resolution of the PKW, she emphasized that she did not prejudge whether the Chamber of Extraordinary Control and Public Affairs of the Supreme Court is a court.

The PKW resolution was sent to the Minister of Finance, who orders transfers for political parties. Domański, however, asked the PKW to interpret this resolution.

The head of the PKW already said that the PKW could not provide an interpretation for its resolution, but he can prepare explanations for the head of the Ministry of Finance. Three members of the PKW prepared projects of such explanations, but at the committee meeting at the beginning of February none of the proposals obtained the required support in voting. It was decided that all three prepared variants would be sent to the Ministry of Finance.

At that time, his own letter was sent to the Minister of Finance by the head of the PKW, who asked him for information on the performance of financial transfers for PiS in connection with the party's acceptance by the Commission of the Financial Reports of the party's election committee from the parliamentary elections of 2023. At the end of February, Minister Domański again asked the PKW to interpret her resolution of December 30.

On Monday, PKW decided that by answering the last letter of Domański, she would use a position already prepared by Ryszard Balicki.

As explained at the meeting, Balicki's magazine was one of three positions sent to Domański, because previously none of the proposals obtained most of the PKW members.

Another PKW member Paweł Gieras argued that Balicki's position is “politically neutral” and therefore should be adopted as the position of the entire committee. Small, clarifying changes were introduced in the Balicki position.

PKW chairman Sylwester Marciniak ordered voting who is in favor of accepting the content of the letter in the version prepared by Balicki. 5 votes “for” and 4 “against” votes in the vote. According to a separate opinion, Arkadiusz Pikulik reported, arguing that his attention was not taken into account.
