If the collected material confirms the suspicions, then the President of the Office will start antimonopoly proceedings and bring charges against specific entities, the Office of Competition and Consumer Protection announced in a statement informing about the initiation of explanatory proceedings to check whether there is a bid collusion in the delivery of ambulances.

In April 2023, UOKiK employees, assisted by the Police, conducted searches at the premises of four entrepreneurs involved in the production or distribution of ambulances. – We suspect a bid rigging, which is why I initiated an investigation and ordered searches, which took place with the consent of the court – said Tomasz Chróstny, President of UOKiK. He added that the Office is currently analyzing the collected evidence.

Potential next steps: antitrust proceedings

He pointed out that “tenders for the purchase of ambulances are organized regularly by hundreds of domestic healthcare entities, and their subject matter is the supply of vehicles crucial for the implementation of many health services. Therefore, we may be dealing with a violation of competition law on the market, which is important for the proper operation health care system”. Explanatory proceedings are conducted in the case, not against specific entrepreneurs, according to the UOKiK website. It was noted that if the collected material confirms the suspicions, the President of the Office will initiate antimonopoly proceedings and file charges against specific entities. Participation in a competition-restricting agreement is punishable by a fine of up to 10%. entrepreneur’s turnover. – Tender rigging causes ineffective spending of money by injured public institutions and losses in the state budget, which can be felt by all of us – said Chróstny.
