On Thursday afternoon, the press secretary of the Prosecutor General, Prosecutor Anna Adamiak, published a statement on this matter. “The case was initiated by information and video recordings provided by the Border Guard to the Military Police Department in Białystok.” Following the actions of the gendarmerie, “a decision was made to arrest three soldiers on March 29, 2024 and bring them to the Military Affairs Department of the Białystok-Północ District Prosecutor's Office.”

“The evidence presented, and in particular the camera recording provided by the border guard, shows that during the intervention against migrants trying to illegally cross the border of the Republic of Poland, the soldiers exceeded their powers by firing at least several shots at them, thus exposing them to a direct threat of loss of life. or health,” said the spokeswoman for PG.

“The examination of the secured recordings from the border guard cameras also shows that the soldiers firing the shots were not in a life-threatening situation. It has not been established that anyone was injured as a result of the shots fired,” we read.

Therefore, the prosecutor brought charges against two soldiers for exceeding their powers and “exposing a person to a direct danger of loss of life or serious bodily injury” (Article 231 § 1 of the Penal Code in conjunction with Article 160 § 1 of the Penal Code). The third soldier was questioned as a witness.

“After presenting the charges, the prosecutor applied preventive measures to the suspects in the form of supervision by a military superior combined with a ban on contact with each other and suspension from official duties. The use of the measure in the form of a contact ban was justified by the information that the above-mentioned soldiers established a false, common relationship between themselves. version of the course of events,” the statement added.

The prosecutor's office also reported that “the Deputy Director of the Military Affairs Department of the National Prosecutor's Office, taking into account the subject and nature of the case, in a letter of April 29, 2024, informing about the subject of the proceedings, asked the Deputy Prosecutor General Tomasz Janeczek for the Department to take over the proceedings under the authority of the National Prosecutor's Office. official supervision.

“By the decision of Deputy Prosecutor General Tomasz Janeczek of May 6, 2024, such supervision was established,” it was reported.

As the PG spokeswoman said, “the proceedings remain ongoing, activities involving personal sources of evidence have been completed, and the prosecutor is currently waiting for the results of the work of the Military Police Forensic Laboratory, which will determine the next procedural steps in the case.”
